by my opinion this brings more publicity to Buddy :D it is good , and i am sure that blizz hopes the same , since we pay the game like normal players , even more accounts :))) and we do a good service having an economy thru AH on wow... they like buddy to.
 
Is there anyway you can record when you go to court with blizzard? Just wanna see them walk out crying while 'I' level up archaeology in background mode :))
 
Inducement of breach of contract is where you could have issues. The German sense of fair play could work against you here. You have to establish that the Eula is meaningless as the contract could be construed to prohibit everything from G15 keyboards to programmable mice and beyond. Do not take anything they have proposed lightly. You need to establish that Blizzard are seeking to punish you because you aren't a big multinational like Logitech or Razer with whom they do business. Speak to your lawyers about the possibility of a counter claim too, you should have grounds on the fact Blizzard appear to unfairly victimising you as a smaller company. I cannot stress enough that you need to turn this into a legal precedent on the validity of the EULA within the European market place. With the right backing you could get this case to European Court levels and Blizzard will be facing an extremely expensive court bill, even by their standards, if they wish to proceed.

Hawker if you're browsing this I'd still like to get a copy of the court papers if possible. You can employ me for a token Euro as a PR consultant as I still have my German tax number. I think there are several action groups in Germany I could put you in touch with that would be interested in promoting this case. This could give Blizzard no end of problems in their PR department.

US court made em do it almost immediately before the ruling was set. In the USA Blizzard lost every part of the ruling except the DCMA ruling somehow because the glider was designed to circumvent Warden. This part is making me a little nervous, but then again I don't know German law. If Bossland was based out of the USA he'd be boned, I'm hoping being based in Germany they'll be fine.

Breach of Contract they say? I thought the contract was between the user/player and Blizzard? With that said no one is forcing us to use bots. Not like HB put a gun to my head and made me use it.

Obviously, as you said, the charge won't be direct Breach of Contract.

However, in some countries enabling/facilitating/encouraging Breach of Contract is also a substantive charge.

Frogster already won a case in Germany were they sued a forum for "Breach of contract". The forum told their users how to sell and buy gold and where they could buy a bot. The court also ruled that the contract between frogster and the players was legal. This seems to be almost the same as in this case.

Inducing Breach of Contract looks interesting. you guys don't really advertise though so it is quite voluntary players using honorbuddy. the program itself does induce breach of TOS but that seems quite tenuous to sue over.

Will Honorbuddy stop working ? No, until the case is finally closed. And we do not plan to stop until we reach BGH.

To clarify this for international forum users, BGH stands for Bundesgerichtshof, which is the supreme court of Germany. It can take quite a while before a case reaches this court, as there are several layers of courts below it. :)

You guys should make a list of arguments, just like you are doing in this thread but in an helpful way, to help their lawyers imo.
