First answer to Activision Blizzard Lawyer / Antwort auf Klageschrift

Its just a paper where Bossland tries to prove that Blizzards accusations are wrong.

First its about Blizzard claiming Hb to use the name World of Warcraft Bot wich would be under copyright by Blizzard. Bossland claims that world of warcrfat bot is only used as descriptiond and that the product itself is namend Honorbuddy/Gatherbuddy and so Blizzards Copyright is not violated. He also talks about some minor points as Blizzard seems to have said they just recently found out that Hb even exists and he sais that this seems very unlikely as Hb has such a bit share of the market.
Also he is refering to the point of fairness that Blizzard seems to have brought up. He states that Hb does nothing a normal player couldnt also do and Hb gives no access to restricted content as there is no such restricted content in WoW (in difference to most free2play MMORPGS were gold farming could be seen as giving acces to restricted content as the company itself sells gold). Blizzard also refers to Hb as a "ch.eat program" wich he says is also wrong cause Hb does nothing faster or better than any player could do it cause its absolutely impossible that software gets better at playing than players. Also you cant do things that others cant like its the case with wall or speedhack. He also backs up his point by referring to multiboxing wich is tolerated by Blizzard but can give one player an enoprmous advatage above the other players. He also refers to the possibility of gaining an advatage over other players by using the WoW-Mouse certain Logitech Keyboarda and or Addons (like raiding addons). He states that all of these tools that are allowed by Blizzard are not fair and Hb is in this case no dofferent than these tools.

Thats most of the content as the document gets very repetitive here as hes just refering to blizzards point and counters most of them by using this argumentation.

Thers a passage where he explains detailed why the WoW- EULA is invalid.
Theres also a part where he says that HB does no harm to Blizzard as Blizzard cant prove that they are lossing any costumers because of HB and it seems more likely that HB keeps more people playing as people quit because of HB. Also he tries to undermine the accusation by showing that WoW and Hb are no competitors but Hb depends on WoW to get sold (this mostly refers to the definiton of one point of the accusation in the law as the products have to be direct competitiors).
He also states that Hb does not tempt us to break the conbtract (EULA) with Blizzard.

If the authentication/login was bypassed, and you could get all the meshes off the net, would it really matter (to the botters) if Blizzard forced HB to shut down it's servers and stop updating the bot? It should just keep running the profiles fine, right?

(Although the more people who had HB, "for free", would definitely increase the likeliness of Blizzard banning people using it - more nubs making it obvious ;P)

Well, since HB "breaks" everytime WoW gets an update, I doubt it would continue working ;)

HB works by reading (and doing other stuff) to memory locations, you might know them by Pointers (C/C++) and Offsets. These offsets are unique to each build, and each time a new build comes out (normally with a patch, not hot fix), those pointers and offsets change, as such, HB must also change.

Think of it as having a case that pluggin your headphones jack into your Ipod, and each time a new ipod comes out the place where you connect the jack changes to the side, so you must get a new case compatible with that jacks position.
 
If it does get ordered to shut down I'm hoping it takes longer than when Diablo 3 comes out. I'm pretty sure a lot of us are leaving wow for Diablo 3

but what if I lost my left hand and can only operate a mouse because I lost 3 fingers on the other hand? THEN WHAT?
 
I really dont see blizz removing ctm. Its there to aid physicaly disabled ppl, try playing With one arm
 
Also Im sure that one or two weeks later we would have a working HB again

True, but the article you quoted does have it in, but yeah you're right about it not being in the English counterpart. But personally I would have gone with an example from a dictionary.
