Demonbuddy injunction, some facts and thoughts ( auch in Deutsch )

Bossland please shut down Demonbuddy for good. I mean it. Jail time and $250,000 is too much a price to pay for this.

its not as simple as that, yeah they could close down a bot that was just becoming awesome everyday, but then again they have worked to hard...

you might aswell say "close down the site" altogether since HB is going to court too..


but all other bots.. just cower down... obey blizzard.. but nope bossland and his team stand up to the bully as they say.

...in germany a court decides on fines as well as jail time... blizz can say many things but here things work slightly different than i the us. You can easily see how dumb they are to threaten with a fine in USD ... the currency used in europe is the euro ... so long.

Keep up hope Boss n team, Besides I didnt just buy a BOT....... I DONATED for support with a game to help me Fight off bcoming a victim to the terrible adicction desease of Video Game Overuse (Video game addiction - Wikipedia, the free encyclopedia). Unlike blizzard who would rather see my life end in a terribly addicted conundrom where my wife and kids no longer know who the stinking unbathed man in the chair is just so i can farm up 15 mil gold to buy some gloves that give me 128dps 400life and .08 prot increase just to make a quick buck.

:) Thanx Buddy team you saved my life.............. You can use that as a qoute to, im sure many others feel the same..... Glad your saving us from a life altering desease

Wie auch schon in einem anderen Beitrag erw?hnt ist die Formulierung ja extrem schwamming. Besonders dieser Teil:

"zugunsten des eigenen oder eines fremden Unternehmens Software anzubieten und/oder zu verbreiten"

Wie sieht denn juristisch eine Beg?nstigung aus? F?r mich als Normalsterblicher l?sst dies die Auslegung zu, dass nur der weitere Verkauf untersagt wurde, nicht jedoch der Support der Software f?r Bestandskunden selbst - schlie?lich profitiert die Firma davon nicht direkt.

Vielleicht kann das unter diesem Gesichtspunkt von den Anw?lten gekl?rt werden?

Zur Einstweiligen Verf?gung des LG Hamburg werden dir deine M?nchner Anw?lte wohl schon alles gesagt haben, und sicher auch das sowas jetzt auch noch kein Genickbruch ist. Ich w?nsche dir auf jeden fall viel Kraft und Erfolg und vor allem die finanzielle M?glichkeit das bis zum Ende durchzuziehen, wenn n?tig bis zum BGH! Auf das Deutschland einig Boterland werde ;)

So, what is the reason we can't still USE the bot if we already have bought it and have previous versions on our computers? Does the C&D mean not only can you not sell it, but you can't have your servers available or usable for customers? I'm not annoyed, just curious how it all works.

Laws are different. Blizzard has to abide by German law on this one.
 
Just shut it down for the good of the team. Most of ask won't even ask for a refund.

They will either get around it or blizzard will destroy the bot. This isn't a permanent statement. People would be outraged if they paid and didn't get a refund when the bot died. It's not that simple dear.

I feel like if anything happens it should be pending the current investigations against blizzard in Germany.
 
Full support on my end, Buddy Team. Looking forward to the case dismissal. Don't let the Glider mentions deter you, that was just the case of a judge who didn't understand the technology siding with the people with the most money, imo. Find a judge who knows about the technology involved and this is 100% dismissed.

If you have to, give a presentation to the judge/jurors on how their statements are false and misleading. Present the facts on why their claims are false (not your methods) and don't be afraid of asking for damages because you too are a legitimate business.
 
I'm glad to see that the vast majority of people are very understanding/supportive - even many of those that are showing signs of worry are doing so politely and positively ("Sorry I have to ask, but, will XXX be possible!?").

What a nice community, and probably a nice bit of refreshment for the Buddy guys after the bad air surrounding the nav-servers recently :D

Good luck guys, thanks for being so open and transparent with us every step of the way, and please to hear you can (and are!) still working on improvements to Buddy ready to unleash upon us the moment Blizzard gets it's legal teeth kicked in by Ze Germans!
 
yeah good community, and if the ( hope for the best be prepared for the worst) hearing doesnt go so good...... You earned my license money, buy a Bier on me :)
