Bossland GmbH v. Blizzard, the never ending story

Bossland didn't win anything. If he did, feel free to point it out here. As me and many others in this thread have pointed out, the second Bossland had made even the smallest of victory, he was right her claiming how triumphant they have been.

And there's nothing to report? So the fact that the courts have disallowed the sale of the bot in Germany is nothing to report? Yeah, ok...

Since you're a moderator here, how about you give us your thoughts on the matter. Do you not think that Bossland very clearly losing this case will not set a precedence for other countries? What are your thoughts on the outstanding cases in the UK and US? Do you think that the courts in those countries won't look at this ruling when they start reviewing the pending lawsuits in those countries?

You're damn right I'm entitled, as well as every other one of the customers that have ever spent a dime with Bossland is entitled.

You seem to forget that Bossland wouldn't be around without us, and now that he's decided to screw his oldest customers over, he won't be around for much longer anyways.

I actually don't need or even want Bossland to post about the pending lawsuits anymore anyways. What he did last night was the last straw for his business anyways. Even if Blizz doesn't put him out of business, he's taken all the steps he needs to put himself out of business.

You don't treat customers the way he does and continue doing business for long.

What is stopping him from just closing shop taking the forum and bot and everything and migrating to wherever?
Rename the bot Haha-bot.

Blizzard legally should not have the source code to prove it is the same software so when he get the letter to stop or be sued he stops and moves to another place with the new LaLa-bot

Of course not moving where he lives just the address of the company?

And as always there is Sealand (the country)

The court does not decide that the software in itself is to be banned, Bossland himself, personally will be banned from operating a business that develops bot software for the game.

He cannot simply do what you think he can, and still be a part of it himself.

I guess they have though about the possibility of him appointing a trusted person as leader of the company and bossland continuing his work through his trusted person but not being affiliated in any legal away ,also?

I guess if he moved to china, he could, but why would he give up his life in germany and his family just to run this bot, thats retarded.

xarian got it right, it's too late for Bossland now anyways. He can't pay his bills now and he's not going to be able to make enough to keep the business going long-term.

And once again, Bossland hasn't come to the Legal section to talk about his Legal problems. Apparently he owes 120k this week, but didn't think that's important info to put in this section.

He has no problem spouting his ridiculous excuses in Discord, yet apparently it's too difficult for him to come to the one section of the forums meant for discussions about lawsuits and give an update.

Bossland is PERSONALLY being sued, if he loses he will PERSONALLY not be ALLOWED to be NEAR or work with or at a company that develops bots for the game

It does not matter if the company is in china, Bossland cannot be a part of it, and he cannot own it, or he would be liable.

Here's some food for thought. As I know everyone here seems to love them some drama, and LOVES to jump on the assumption wagon. There is no such thing as loosing in court or winning. Why? Because things change so fast, so trying to determine the future of Bossland by who's "winning" or "loosing" is horribly flawed. Also, Xarian, I get you are trying to be a "realist" but you omitted one major thing about all of these "losses" Bossland has suffered.

There is no such thing as a final decision until a highest court of an area makes a decision and marks it as un-appealable (for lack of better words).

This means, while yes, Blizzard can continue to swamp Bossland over and over again in Courts, all it takes, is ONE single ruling that cannot be overturned in favor of Bossland, just one, even if he lost 999,999,999 other cases, it only takes 1 to undo everything else, and seal Blizzard from attacking them in that country again. So long as one country can operate, there will be profits, so long as there is profits, its worth supporting the community.

So, if you want to be a realist, present the cold hard real facts of the courts. Not just what you see, in a time of despair please.

On one final note, what saddens me the most, is how swift you people give up on Bossland, the guy who hasn't given up on us, who is STILL fighting for us, no matter how demanding, or greedy some of us get. No matter how harsh and unrealistic some of us can be. He hasn't given up, and is still in our corner fighting for us. Yet the second a ban or an update or something seems to not go your way, you all bolt on him. Talk about a thankless job, with low end loyalty from the community. The issue is the vindictive people who get banned and then run reports against botters because they are butthurt. The people leaking information to other companies (ie. blizzard leaks) and the ungrateful attitude of the community.

Before we pick the faults of bossland, why not change our own attitudes and be faultless.

And before the raging posts of "Oh you're only saying that because you work for him" just a heads up, I have been preaching that for a while now, way before I joined the team...

And all it takes is 1 court case in Blizzard's favor and Bossland is done.

He doesn't even have enough money to pay 1 fine in the UK courts, how is he going to have enough money to continue to fight to win? If you have no money to fight with, you lose....And it's pretty clear that Bossland is out of money to fight.

If you didn't want us to give up on Bossland, maybe Bossland shouldn't be doing everything in his power to fuck over his customers. And then you have idiots like you and Tony saying that Bossland and the HB team are the good guys in this situation....Once again, you are an idiot, Tony is an idiot, Bossland is an idiot. It's pretty obvious that Bossland is only fighting for himself and only cares about himself.

Well, I won't say that "you are saying that cause you work for him", even with that being true. But these thoughts of you seem quite biased.

Everybody wants Bossland to succeed; but creating a false legal situation (which is what you did with that crazy court explanation) ain't exactly the best way to encourage that.

Of course, decisions can be appealed at a higher court. But given that enough decisions have been taken on one direction by other jurisdictions / courts, those decisions can and more often than not will be taken as
case-law and precedence. Very rarely decisions will go on other direction when that happens. Extremely rarely, if you prefer.

About your sentence of "it just takes 1 ruling on Bossland favor to seal Blizzard of attacking him in that country" ; correct if it is the highest court of the country and 1) there's no international related courts that can be of appliance or 2) Blizz manages to bring the case to US courts which might happen.

But that goes both ways, it just takes 1 ruling on Blizz favor to seal BL of selling HB in that country. And, meanwhile, there can be dozens of courts with huge costs for Bossland. It is absolutely unfair trying to choke Small and Medium Businesses with this behavior, but it's the way it is.

How will he be able to sustain and fund that legal cost? Another shady treacherous trick like "HB3 is over cause we just developed HB4 which can operate in 64 bits, please pay again" ? and then again?

Also, apparently you consider that Bossland can go from country to country, and if they lock him on one, just switch to operating in another country? Seriously? Once this legal issue has set a precedent in Germany with a final decision, that will go beyond its borders faster than what you imagine.

And that's not bringing PL into account.

No matter how you or anybody else rephrase sentences, talk about "community" "support" or whatever. Breach contract is against law, people are pissed about this and some will take actions.

Seriously you wonder why people give up on Bossland, if he, out of nowhere, just broke all lifetime contracts, seriously? lol...
