That will still only apply to the EU which if they were to get prissy enough they could stop service to the EU I don't think they will but that is a option if they don't like the court ruling. Though it would be a public relations nightmare

They would lose millions in subs. The EU could change their flag to the Honorbuddy mascot urinating all over Thrall's face and they would still have subs.

Please, do not share senseless fairy-tale stories. This is too absurd to even worth the comments.

Its honestly a rather logical conclusion. EU law doesnt spill over to the USA. If Blizzard doesnt like the laws in an area, they can always decline to offer services. Public outcry is part of life, when people dont like something, sometimes they complain. Thats how the world of business works.
 
Couple questions:

1. If you succeed in tying honorbuddy as for private use, what would that mean going forward ? Does that mean that blizzard will be forced to allow honorbuddy without the banhammer (good for users), or does it mean they can no longer attack honorbuddy itself (good for 'buddy' products) ?

2. After a cursory glance on this, I can already see what appears to be a possible flaw in this, which is:
a) if blizz can prove that HonorBuddy is used for profit, then it can not be categorized the same way as wow itself.
b) ^ would set a defining point which would draw a hard division between honorbuddy and wow .

I think to prove #2, they would likely need evidence of monetary transactions which have occurred out of the usage of honorbuddy itself. To win this, I think you would need to show some pro-active approach to stem the use of HonorBuddy for commercial/business use as blizz has shown effort to stem the use of wow from being used commercially for profit. Not sure how this would be done exactly, but perhaps a good start would be to update your license to include statements prohibiting the use of buddy products for commercial use. This should not affect the store as those are products which extend honorbuddy.

Thoughts, hate mail, whatever. Would like to know what you think on this ?

What I honestly do not understand is They allow Addons which lets you see things you normally would not see without a 3rd party, but they do not let you use a bot that automates your moves that you would do anyways? There is no real difference but they allow it. Could this be, that they get a profit from the addons?

The addons they can control by releasing the API's for them. You can only see/interact with what they want you to.
 
So you guys are suing Blizzard for using the bots in court to demonstrate that it infringes their ToS? Man...German IP Law is hilarious

Probably....are these judgments published anywhere? Would like to read them...ECJ as far as I'm aware is pretty good with publicly available judgments
 
From what I got out of the e-mail i sent to Blizz from my banned accounts I will be getting them back some time in the next cpl months. It was a 6 month temp ban for me.
 
The english is a little rugged, however if I am to understand this correctly. The point of this suit is to block Blizzard from searching the Ram for Honorbuddy. Also to completely ban the use of Honorbuddy ect. by Blizzard. This would block them from seeing how the bot actually works and make it much harder to detect, or verify what exactly is running while its game is running. Is this correct?
 
It's illegal in most countries for a company to search your computer for anything.
 
Not when you accept a ToS that gives Blizzard some pretty broad powers in relation to your computer. "Privacy" is not a right that you can't sign away through a contract.

loll.... "Where I'm from" does not make the slightest difference. When you sign Blizzard's TOS it makes it VERY clear that you will bound by U.S. law which firmly establishes the US as lex loci (look it up.).

What you're saying is the equivalent of: country A legislates that all citizens of country A should not pay for goods delivered by any other country. A person from Country A then signs a contract for goods delivered with someone from Country B, agreeing that he will be bound by the laws of country B, and then points to the laws of country A as a reason not to pay. Sorry mate - you're wrong on this one.
 
First of All: not all thing blizzard writes in the ToS is actually true
2nd When I buy something in Germany, I will deffinitly be jugded by german laws ( thats a fact )
3rd I can´t find the actual news but I can remember, that Blizzard had to pay a big fine ( from the Federal Data Protection Commissioner of Germany ) because of Warden.

PS: is there an update / News regarding the Lawsuit regarding the german version of HB?
