blizzard robbed me... no joke

Hello ct12yyy, did you use the reason that bliz took your right to play d3 and did you file a complaint with the Los Angeles Better Business Bureau? Thanks
No...i just ask paypal for a refound couse my product is not "working as intended" :)
They need a legal reason to decline refound...immagine they can`t tell paypal "that guy was using demonbudy and that`s against our ToS" without proof.
And they can`t tell "we scann his computer and we found ....X and Y" couse is kinda not legal.
So the only proof will be " he was online 24/7 "?? And...?

so basically if i were to ask for a refund, i just ask it without having to talk about not being able to login or bliz taking my right to play. all i have to say is that the game is not working as intended. am i correct?

1. File paypal claim for all transactions within past 45 days.
2. File chargebacks with your credit card or bank for as far back as they will let you (in my experience 90 days) for all RMAH purchases.
3. Tell blizzard through ticket and through certified mail to their address listed on dispute policy website of your intent to enter arbitration.
4. Tell them since you did not agree to any terms of use or service (or eula) when you purchased the game, and when it was already installed you could not return it, you had no other option to use what you spent 59.99 (or w/e amount on) besides to click the accept button when presented with these terms.
5. File a complaint with the Los Angeles Better Business Bureau (la.bbb.org) for full amount in total spent on game and on rmah transactions, if possible include printouts of total billed in billing agreement on paypal and any credit card or bank statements.
6. Contact Blizzard through tickets repeatedly informing them that as the only route of contact to the account administrator, through tickets they must commence in negotiations for 30 days or forfeit (sever as per section 7) section 1. When they close a ticket immediately open a new one. After being ignored and/or repeatedly told that they will not negotiate or change the penalty under any circumstances, inform them that any response not explicitly mentioning intent to negotiate at all will be interpreted to mean they are (a) not upholding their own terms, and (b) effectively severing section 1 of their policy.
7. Warmly thank them for their help speeding up the process to enter arbitration and recovering funds lost in this gross breach of privacy rights!
8. Never admit to anything ever.


We can agree to disagree on whether a botter should expect to be banned or whether it is legitimate to recall funds in the event of one; However if you would like to follow my client down this path she has been successful already getting all funds back from purchases with 90 days, and still waiting on blizzard legal department response (can only reach by physical letters mailed) for the rest. The compensation for 90 days is sufficient to recoup most of the actual net losses though, so we are both content, yet confident moving forward. Best of luck to all.

My personal standpoint on this is; if you purchased directly from blizzard, you will have a hard to recovering anything other then the purchase price of the title. On the contrary, if you bought retail you will have a easier time recovering money spent on the RMAH, but won't be eligible for a refund for the retail copy most likely (which depending on the user might be better or worse, for my advisee, lets just say she is glad she bought retail).

Weird. Mine was being processed and got banned. I got my money. Dispute it.

thanks alot tbgvtr. for me my biggest sunk cost is the game copy rather than the 40mil(like 13 bucks) spent on gears, and therefore getting game copy refund makes more sense to me. thanks for the detailed info btw

You can't. All you can do is try and fuck up the keystore and chargeback through paypal. However, with this action you wouldn't really do anything to Blizzard. All you would do is damage the business of the guy who sold the key to you.
 
I had an account banned with 500m+ worth of gear on it. The items are still there on armory ;). If someone was running some kind of scam that worked at Blizzard, they would've definitely taken some items off of that account. Honestly, in my theory, the items are bugged on armory. You're viewing an account on Armory that has been BANNED. You don't think there's the slightest chance of a bug?

Initiate an investigation by contact [email protected]. If someone was actually doing this, it would be a HUGE liability on Blizzards behalf. I'm sure that they already have a system in place for monitoring their team's activity, but you can give it a shot this way if not.

The fact remains that this guy lost an account and got pissed. Now he's just looking for any reason to sue Blizzard for the $60.00 he lost for violating TOS/EULA. Perhaps more if he was stupid enough to purchase items from RMAH for real money if he was botting (offense intended). Every single person and their mother that gets banned wants their shit back. Some people want more and thing they have a strong case against Blizzard for this. There have been 100's of conspiracy theories about Blizzard for 10+ years now. So far, it hasn't seemed to stop Blizzard.

also, i told them i have proof of a player hacking and cheating his balls off, they dont care, i said i would do it as well, when i said this the woman asked for my name and battle tag, i told her there is no need because if i do get banned for it it will be an easy lawsuit proving blizzard is NEGLIGENT by banning me and not someone who is publicly hacking and making videos.

it was a good troll but, blizzard honestly does not give a fuck, havent u seen there new feature? they greyed out 90% of the support ticket buttons for issues and when u call its either "right click the player ingame" OR there is no department for that. so either way unless you pay a lawyer u wont win vs blizzard.
