Blizz legal issues with HB and GB

Well, looks like blizz has caught us and hb&gb are being brought to court soon. What does anyone think is gonna happen?

I believe that blizz will do the same as they did in the michael donelli case, hb&gb will be shut down till the court case is finished, a four year court case will happen, and finally we will have spent our money for nothing.
 
I feel like it probably will most definitely will be shut down, It's just waiting for it, Nearly all bots that have been targeted by Blizzard have gone down, and quite honestly, and this Is only my opinion, but I dont think they have much ground, like I'm sure Blizzard would have their ass covered before doing such thing, but again, I don't know, This could be far from the truth, but it's just what I think.

well, how does it work in germany then? I dont quite think it would be possible for someone like you or myself to compete with activion, you do realise activion has made games since sega right? I highly doupt hb&gb as a whole could possibly beat blizzard in a court case especially cause blizz has more like 50 lawyers and gb&hb have more like 1-5.

To get to the point let me start by talking about the donelli case.

when the court case got about 2 years in this was said:
The district court found that Donnelly was personally liable
for MDY’s tortious interference with contract, secondary
copyright infringement, and DMCA violations. We vacate the
district court’s decision because we determine that MDY is
not liable for secondary copyright infringement and is liable
under the DMCA only for violation of ? 1201(a)(2) with
respect to WoW’s dynamic non-literal elements. In addition,
we conclude that summary judgment is inappropriate as to
Blizzard’s claim for tortious interference with contract under
Arizona law. Accordingly, on remand, the district court shall
reconsider the issue of Donnelly’s personal liability.24 The
district court’s decision is VACATED and the case is
REMANDED to the district court for further proceedings
consistent with this opinion.

So the court case went on for another 3 years and 10 months, this was the result:

So the order came out today on our petition for whether Glider should fall under 1201f2 as interoperable software. The court denied considering the petition at all, claiming that we hadn't raised the argument before.

It's a little disappointing, since we did raise the argument and even showed where in the petition.

I guess they really don't want MDY Industries to sell Glider, no matter what the statute says. Enough to leave some bad law on the table.

I'm not sure what'll happen next - it always takes some time to digest these things and figure out what's next. But it's certainly a setback and there's a very high probability that Glider will simply not ever come back.

I'm including the order in-line in the post, since it was just a docket entry and not a real PDF.

Glider was killed, But to say the least glider was not much of a loss, this bot however is a huge loss for people in the us almost 100 us dollars for a program that is going to be killed in a matter of months.

I dont care what happens, a better bot will probably come out anyway, wow is old and boring now, mabie you should pick a better more fun game and just let both die

where is the problem, the code will go on to another company and they sell the bot again.

please stop all this new threads about, will lifetime lifetime, or will i get a refund or other things, at the moment bossland will go on with his business, there was a new release. i think they are thinking about a plan-b if shit happens, but please stop all this cry threads.

I completely disagree, I payed for a program and it should be usable for the rest of the time I live just like the program states. LIFETIME.
 
But WoW was made in the U.S, and since this product "Targets" it, doesn't the laws of the U.S only apply?

Like I mean, if wow was made in Germany, then the current laws in Germany would apply whether its allowed or not, but since its from the US, if the US laws dont like it, then it doesn't matter where the bot was made, since its targeting product within the U.S, they still have all favors in their court.

again, I could be wrong, my head is fried, and quite honestly I dont care what happens XD

If the company was established in Germany, then of course German law applies. Otherwise we could just have a universal law system and different laws for each country wouldn't matter anyways.

lol at people thinking WoW and HB will be alive until the day they die.

Lifetime means you get it during the program's lifetime....you act like you paid $6000 for it...
 
Tbh even if HB wins blizzard will be even more pissed and they'll never leave them alone. So as far as im concerned this is a loose-loose situation, even if hb wins in court.

Dont worry so much about whats gonna happen thou, it will take alot of time, most of us will probably be done with wow by the time this thing is settled anyways

Id suggest you stop being a dick, me and other people are conversing about the topic. You dont like it? then dont come on the thread, also your whining about us is worse then our whining about what happening. You're whining for nothing, the only thing your losing is patients with us, where as other people are concerned with the fact they lost 85-a few hundred us or eu currency for a bot that didn't even work smooth and is now being put to rest by blizzard.

Programs dont have a lifetime, their not living things, their numbers and letters :)

I have to agree with Megser here. You get it during the programs "lifetime". Don t try and be smart by saying its not a living thing thus it has no lifetime. Lifetime here means not literally life as in human living being. If you don't understand that indeed I seriously dont see how you can even be able to use this software.

But I don't think you dont understand that. I think you rather just trying to be a smartass which is very childish and shows us that you resort to lame reasoning if you can't seem to "win".

I seriously hope HB will win this in court tho :/ If I can't bot I will probably quit playing alltogether.
