Like the last few weeks have been an obvious occasion where they were doing detection protocols but accounts not used in that window seem for the most part to be safe. That alone tells you it's not a 100% detection rate.

Depends on the legal system you have. Blizzard have working into the EULA and privacy sections that you let them collect such data for the purposes of countering cheating, hacking and 3rd party botting programs. By agreeing to it and providing it is enforceable in your location you really don't have a leg to stand on in terms of the law.
