A user of this account has recently been involved in actions deemed inappropriate for Diablo III by the In-Game Support staff of Blizzard Entertainment. This decision was made after a thorough investigation of the situation as a whole. Though we are unable to discuss the outcomes of our investigations due to privacy concerns, rest assured that this incident has been looked into very thoroughly, and the appropriate actions have been taken on all involved accounts.

Account Action: Account Closure
Offense: Unapproved Third Party Software
A third party program is any file or program that is used in addition to the game to gain an unfair advantage. These programs may increase movement speed or teleport heroes from one place to another beyond what is allowed by game design. It also includes any programs that obtain information from the game that is not normally available to the regular player or that transmit or modify any of the game files.

Cheat Programs ("Hacks")
We take action against accounts using hacks when a hero on the account is identified using a hack program. Hacks provide benefits normally not achievable in the game. Such benefits may include: increased speed, teleportation, or running through walls.

Automation Programs ("Bots")
We take action against accounts using automation programs or bots when one or more heroes on the account are identified using a bot to achieve automation.

This Diablo III account has been closed by our staff based on a review of the account and all related policy violations, in accordance with the Terms of Use and our In-Game Policies (Diablo III Policies - Battle.net Support). Note that any open bids or auctions at the time of the account’s closure have been cancelled. Your open bids will be refunded to your original method of payment. Please allow 5-10 days for processing depending on the availability of your financial institution. Any bids or auctions completed prior to the account’s closure will neither be refunded nor reversed.

Moving forward, this Diablo III account and any Heroes or items associated with the account are no longer accessible. The only way to continue playing Diablo III is to purchase a new license, or to attempt to recover access by appealing account closure. While closure overturns are very unlikely, we advise that customers pursuing an appeal hold off on purchasing a new Diablo III license until the appeal process has completed. If you add a new Diablo III license, a new account will overwrite your old, without any prior Heroes or items from the closed account.

Any disputes or questions concerning this account action can only be addressed by Account Administration. To learn more about how Account Administration is able to assist you, and how to contact them via online ticket, please visit us at Account Administration Overview - Battle.net Support. We will be unable to investigate account actions over the phone - an online ticket is the only way to contact Account Administration.

You need to stop acting like you know the law. Either move on or go back to the law school you never went to.

you would lose. You agreed to the ToS/EULA. By agreeing to that, blizzard can terminate your accounts for no reason.
 
at the end of the day are accounts are all pawns in blizzards world, and if the cheif's get hungrey im sure they can loose a few,

He might be wrong in your country, in germany you could make a strong case with it claiming, that the account gold etc belongs to you and they unjustly took it from you. They can't just terminate you here, without fear of legal reprecussion.

That was last time I checked, didn't check in a good year.

ToS Eula? Wrapper contract not even legally binding. Even if it stands on the box, I had no way of knowing my main was preordered. (Obviously I kinda knew what I was getting into they aren't that different after all)

They will probably get a legal letter for an account termination on my main which never botted, all based, that the account indeed does belong to me, then they have to proof, that I did something wrong and not my malicious little cat that likes to bot.

Depending on the country you're wrong. You bought a service they cannot deny that service for no reason. The EULA/TOS are not legally binding and do not replace US or EU consumer protection laws. They can however ban you for being associated with botters its guild by association all they have to prove is you traded or were in a game and benefited from botting even if you were not botting you benefited from it. People need to stop saying they can ban for no reason they cannot.
 
I cant remember who it was, but a guy from this forum called them and asked:

Can I be banned if I traded with another guy that was botting, and I was not aware of?

The bliz rep said something like, "no becuase that person could just be an innocent bystander"

Read the EULA. They clearly say that they can ban your account for no reason. Im not debating the fairness of what the EULA says, but rather im just simply stating the facts. Is it in blizzards best interest to ban people for no reason? No, but its something they can do. If you disagree with the EULA, you should have not agreed to it.

yes which is total bull

ive said this b4, but its really totally bullshit if a "real" innocent person got banned from trading from a botting account a few times, and he had no knowledge..

They Should require proof, but thats Bli$$ard for ya

When they had their meeting and created this TOS it was probably something like:

"hey we need a way to ban botters if their accounts look like they are botting but got no proof and any accounts associated with them"

"what if the associated non botter gets caught in the middle"?

"oh well ban them so they can buy new accounts and make us more money!"

"oh yeh great idea!!... its settled"
 
5/5 Banned today including main which I didn't bot on.

Has anyone that has been banned today ran only longer profiles? Such as A1 elite killing, or goblins? Or are most of the bans core, sarkoth, and lvling profiles?
 
I have a plan, lets all drop in 100 usd, and buy our self a contry? and make the rule, that botting is allowed :D
as you started law rules is higer up against tos/EULA :D

watch out dude, Some have reported that their mains got hit, just by transforring gold/items :D poor friend
 
I loooost 15/23 accounts today. None of which were online, I was trying to ride it out since monday. All my lvl 60's are hammered, and all i have left are my semi-ZK exploited level 50-53's that werent quite leveled yet.

Price of gold is about to go up, quality of game is about to go down. Im not buying any more accounts they are going too ban crazy. They can ride their shitty game into the ground.

At least now I earned the capital and re-invested in $1k bot rigs for GW2 next month

they can do it, their TOS and us clicking agree says that they can close accounts if they wish to for whatever reason

its very unethical but they can

not saying im innocent

but what if my bro or friend came over my place and we played d3 together and he gets banned, and he didnt know

that is very wrong

Come on dude.. all these "what ifs" lol You remind me of the ***** heads getting caught on the Cops show. " Its not mine! Someone put it there!" lol You bot, you get banned sooner or later. Happens to everyone.
