Would the government allow me to run a gold selling business?

I'd like to know in which countries could I legally run a gold selling business if I found it potentially profitable. My plan is to sell gold directly to professional resellers and/or use the real money auction house, not to have my own store. I would create a company (or become self employed, whatever seems more convenient) and pay all the taxes, but I don't know if the government would even allow me to make a living from this activity. I'm currently living in the United Kingdom, but I'm also interested in knowing how it works in other countries (Ireland could be a good option because of their lower taxes and proximity to here).
 
You do realize that it is against Blizz ToS to sell outside the AH/RMAH, do you? Unless you make a lot of money to cover the lawyers when blizz gets you I do not see the point.

I wouldn't bother going to the trouble. Just sell it and if you must just put the tax money aside. Chances are youre not going to make enough money to generate any attention.just my 2 c feel free to disagree.

everything is legal until the courts say it's illegal, that's the problem with grey area business... they're considered high risk and therefore you would be charged very high fees if you accepted credit card processing.

also, you're clearly breaking ToS but that doesn't mean you're breaking the law... bots are not illegal in Germany BUT blizzard are still suing and that could cost Bossland if he lost.

let me make this clear. it is against their tos to sell outside the AH/RMAH, however that doesn't make it "illegal" blizzard doesn't make a LAW, they make an agreement. we agreed to their terms to play their game, and when we don't, they can ban or suspend us from playing their games. THAT'S IT. They can't take any legal actions on you selling gold.

nice BS there :P they cant sue you for breaking ToS, they can sue you for breaking the copyrights just like they claim buddyforum did...

yeah a TOS is not a legally binding contract, there is no legal precedent for it,.
 
I will tell you again, go to germany. Here you get the ownership of the gold and items you earned. I read it several times now but I couldn't find the precedent case myself.

I am currently starting a business here in germany it is already taxed etc what I do and soon the whole project kickstarts. Germany is where you want, but also you should realize that the companies will try to hit you sooner or later and you will need to have saved the funds to make the stand.

Or you wait a couple of years and can leisurely do it after I have made the precedent :D

The government would never bother you as long as you pay your taxes in the US. You are a supplier not a distribution center. Just get a DBA and worse case set up an S Corp and just funnel everything you make through that, while paying yourself hourly wages/+ bonuses / + wtf you want

I'm not considering whether or not to pay taxes, but whether it would be legal to have that kind of business.

That's also what I think. I'm much more worried about the government than about Blizzard closing my accounts and having to buy new ones. And I'm also thinking about just using the RMAH, so I wouldn't even break that rule.

I'm currently living in the United Kingdom, and I'm not from the US but from another European country. I don't understand what you mean with DBA and S Corp (Doing business as - Wikipedia, the free encyclopedia and S corporation - Wikipedia, the free encyclopedia ?).

Anyway, my doubt is if I could even run legally that kind of business, then I would have to check if it's better to me to work as self employed or create a company.
 
i would say, your only limited by your imagination and the laws in your area.
 
Blizzard will try to get you legally out of business, because they have to. They are expected to do so and they will try to delegitimaze your business on the ground of botted gold. There are probably a lot of ways to attack you. Comparing your botting activity to the normal user and there you would have an unfair advantage etc.

Just don't be dumb in that regard, even if they have little legal grounding they will try, because they have to. They have to make a stance against botting and for them those legal fees is just a fart. Prepare for that and I wish you the best of luck in your endeavor.
 
Nothing in the US says its illegal. When they sue you just triple your business to pay for legal fees :) It's like when they ban your bots buy 3 times as many more :)

So the biggest risk is they making me stop or could I also have to pay big fines (creating a limited liability company would limit my losses)?

No US court has ever ruled it against the law so they cannot shut you down without actually getting to that point and even after that you can appeal for years while still running your business just like they will appeal any ruling that isn't for them. In the US something like this would take half a decade to go through the courts/appeals.

It is easy talking about it in third person. Those are not chilling 5 years if it involves you, your future, your business.
