Why doesn't Blizzard sue botters? Is it really not against the law?

Can't you be sued solely for violating their terms of use agreement?
 
It is much cheaper to ban. Wtf kind of question line is that anyway?
 
Your response says it's illegal but that doesn't mean they wouldn't make an example out of you. It also contradicts what's posted on the purchase page for the bot: "Botting in Diablo 3 is not against any law, except in Germany."

I'm just curious about the matter due to a friend being concerned about possible legal action for doing such a thing.
 
It's a breech of their rules that they set. Lol it's not illegal. Completely different things

there is nothing illegal about botting. not even gold selling is illegal. as long as you pay tax. but it is against the game rules. so the game host can suspend you from the party.
 
botting isn't ilegal against the law
botting IS ilegal against the terms of service

I could create and let everybody agree with the terms of service when I change it and add "being an boy isn't allowed and will be punished with an ban" this could be possible but I can't say in the terms of service "being an boy isn't allowed and will be punished with an 1000k$" because this isn't the law and I can punish you only with in my site/game
