Once you are banned, i dont think there is an option for you to even upgrade. Just an empty screen with the words BANNED

I know if you have a standard edition account and you register a collector's edition key, your standard edition gets upgraded to CE with all your progress retained as that's what I did. However I'm not sure if it can be used to remove the ban status.

if you buy a new d3 and add to the banned acc, it will be unbanned but all your progress will be wipped (0 achiev, 0 char, 0 gold and etc) so you will have to start all again.
