I was on the phone with customer service to try to unbanned my main account. This is what they told me, if you have a 3rd party program running at the same time as D3 even if you are not botting you will be banned and it will not be overturned, so it was either demon buddy or isoboxer that caused my ban. anyone use demonbuddy without isoboxer and got banned this last 2 days?

I am trying to find out if it is demonbuddy that is detectable or is it just becuae of isoboxer

dude, its not detectable atall, diablo 3 is just a easy game to tell if you are botting or not, i did not use ISboxer, and still got 5/5 accounts banned
Its bad luck, stop saying if its detected

customer service told me that a 3rd party system was found while i was running d3 so it was either isoboxer or demonbuddy from the way he explained it to me

They might use Warden to read your computers process list (which is illegal).

They may, but they DO NOT, since the 1st time Warden start to scan processes outside diablo iii.exe memory, hundreds of people will notice it, and Blizzard will sink as company in only several days. Happened before, will happen again, if they do it.

If it were me on the phone, I would informed the representative that I was recording the phone call, then specifically asked if this were the case and if so notify the representative that it is an illegal action; also that I would have to inform my lawyer about this incident.

I was reading over their TOS yesterday a bit, and it said something like, Our service will read your RAM etc for other third party programs etc

So ye you hit AGREE and allow them to do that

I can find and get the exact link when I get time

So maybe they can detect what third party programs your using even if your not using it with D3, (not saying DB but it could be anything else like ISboxer etc)

They can scan around but not collect the data.

Well can see what programs are running in the RAM?

DB probably has something to hide this, due to being a bot, but maybe ISboxer doesnt? who knows

Well this is what I found yesterday:

Section 2.D:

Use any unauthorized third-party software that intercepts, "mines", or otherwise collects information from or through the Game or the Service, including without limitation any software that reads areas of RAM used by the Game to store information;

Source: Blizzard Entertainment:Diablo III End User License Agreement

I get and understand what your saying. But remember this one thing! They can put ANYTHING they want in that TOS. But that doesn't change the laws of the land. You CAN NOT collect information from any process running on a persons computer unless you are part of an organization deemed by the government of your land.

Ex: They can add. We will kill your first born child. Doesn't make its legal! (Harsh example I know. I use it to prove my point). Now this isn't what they are doing. But if they are collecting information. We would find out and they would pay for it... A heavy price at that.

Ok fair enough

Im not good with law and all, but would by us clicking agree, is that like us signing a contract saying "yes you can read my ram while im using your service?"

If that was breaking the law, im not sure why they would state that in their EULA and create a hole for themselves. Im sure they have very good lawyers and stuff and know whats allowed and whats not

Has anyone actually read the laws, that this is pertaining to? I would like to see links provided of such documentation, as I was unable to find any. (About it being illegal to scan/use memory data from outside the program itself - IE: scanning processes to find third party programs.)

Just because Blizzard is held accountable, by law, in the United States (or where ever) does not mean that each country holds the same laws; instant example that Demonbuddy can not be sold in the country of Germany, but there are no restrictions for outside of it.

Law works how lawyers make it work. Words often fall into grey areas, which must be debated (that's the lawyers job after all) to find their exact integrity. While Blizzard may not be able to do such scanning in the United States, does it explicitly say that it pertains to other countries as well? What about countries where there are no software laws? (See where I am going?)

also Isboxer isnt against the TOS. ive been multiboxing blizzard games for years. You can multibox with no fear of being banned. Isboxer is legit and non bannable. You can ask lax him self he has gone to court with Blizzard in the past and won.

I guess no one has actually read the legal documentation? lol
actually a few years back Blizzard got taken to court over its warden reading our computers mem and storeing teh data. Thats invasion of privacy and there is a court doctument you can google and find on your own.

im using both. havent been banned. not detected. or i would not exist. that CSR blatantly lied to your face.i would demand to know what specifically they "detected". its nothing thats why he was vague.

Maybe you misread what I was asking for? I don't give a shit about Blizzard's legal issues. I was asking if anyone has read the legal documentation that specifically states where, when, and how software is not allowed to read, or use, data collected outside of it's scope; memory allocation, ect. Maybe read my comment again?
