Possible to get refund/win PayPal dispute after ban?

i swear to god you dumb asses that get banned for botting then doing charge backs are really the scum of the earth you knew the risk take the blow and get back to it dont think you can justify your chargeback because you got banned in a broken game you do a charge back then buy the game again and get banned again really i mean no wonder the world is going to hell as said before scum of earth and should have demonbuddy keys REMOVED

acutally charbacks and returns are legal. The ToS isnt a legal binding conract where PoS is. (point of sale) You have the right to return items for what ever reason with in 30days. IF you are banned with in 30days of botting there is nothing anyone can do. "ANY REASON". Now out side that 30day window it becomes different on how you purchased the item. if you payed with paypal you can charge back and get your money back no questions asked. Because the TOS, EULA are not legal binding contracts you are able to legaly get your money back. Yes you broke blizzards rules but you didnt break the law and they have no legal right to stop you from playing a game that you paid for. Now returning to a shop maybe harder. You may only beable to exchange it if it is after the 30 days.
 
ONLY problem is that PayPal does not help you if you dont get what you payed for if it isnt a physical item. Intellectual property/non-physical objects are not covered.

Wrong. I got a refund when i disputed H*llbuddy when they got ban waves. ( i didnt get banned i never used it, but didnt want to use it anymore after that)

No I was referring to people like you who just above that posted how you basically ripped off hellbuddy. When it suits you, you will try and do the same to DB most likely.

How is it ripping them off? I paid for a product that claimed warden protection. They clearly got nailed by warden (and reports of other devs stating that they had 0 warden protection), so it's false advertising. Didnt get the product I purchased. Period. It was also in the 30 day purchase window. You can get a refund pretty much for anything in that window on paypal.

actually im well in my rights to return a product that i paid for that i can no longer use. Nothing moraly wrong. Blizzard actually doesnt have legal right to ban us for botting. The EULA and TOS are not legal binding. If a botter had enough money to take blizzard to court in the US he would win. Furthermore in the EU it has already been determined in court that the EULA and TOS are not binding and that blizzard cannot ban you. Recently it was pointed out that blizzard cannot ban you for selling your account because it is yours you own the serial key and everything attached to that account. the moment blizzard sells you that key they lose all rights to it it becomes your property. They cant prevent you from playing the game you paid for. Or selling that account for that matter. Now no one has taken them to court in the US so this doesnt apply there yet, but it doesnt mean their EULA or TOS is legal binding there is just no precedent "YET"

In case you are to stupid to figure this one out. D3 bots are a huge bandwidth hog for Blizzard, specially when you sell stuff outside of RMAH, they get 0 compensation for the power/internet/support they paid for keeping the physical location of the servers maintained.

just as blizzard cant legaly bann you from botting (automation of key input)

The guy that made Isboxer acutally went to court and beat blizzard. they where banning him and other multiboxers because of the multiboxing software was automating key imputs to other accounts attached to the 1 main account. Pressing 111111 doesnt translate into 123456 normaly so its automating that type of imput. But he won because he had the money to fight it in court. Same thing would happen if someone could afford to take blizzard to court over botting. we are not hacking their end of the game we are just automaitng normal key imput. Which we by all rights have the legal right to do. Now hacking their IP is against the law and they have the right to ban you for that. but botting no legal right.

Its on lax main page he talked about his court issues with blizzard.

Ive been multiboxing and using isboxer for years. just about ever since its been up and running. I use to Multibox BC and multiboxed Wotlk did my own 10man clears of Nax. I know the history i been banned for multiboxing and had it overturned. Lax's Legal issues with Blizzard are known.

Now tell a judge why the second one is not legally binding, because it will be. You have to understand one thing, the wrapper contract is not legally binding, because you have no way of knowing pre purchase. When you already went through all of that and purchase another one it becomes a completely different story.

You cannot use the product anymore, because you broke the ToS, as far as they are concerned they gave you your money's worth and your attitude just sucks. There is a huge scope between it is not illegal and finding justice doing something.

Seriously you guys are so desperate for cash it is disgusting to watch. I bet when you get chargebacked by goldpurchasers you like that too and you know what? They are in the green doing that too, it doesn't make it right.

Services are not treated the same as products, you keep acting like you have a product, they are offering you an entertainment service.

what they say and what they acutally selling is up to a court to determine. they can say they are providing a service. but when in fact they are selling a product.

Some of you may not realize this, but there is a bit of legal history between me and Blizzard. You can find information on the internet if you really want, but the real point is that those days are long gone, and these days are much better for everyone involved. Blizzard wants more customers that they don't need to ban, I want customers that are not at risk of being banned, and, well, none of you want to get banned. That is win-win.

I would like to point out i havent ever done a chargeback on a game when i have been banned in, I'm just saying that its legal to do so if you want to.

For the record, neither have I. Only done a chargeback on a bot i preordered with certain expectations (advertised features) that turned out to be false. Never charged back a buddy product and never will.
