If I was the head honcho in charge of Diablo3 at Blizz/Acti and if I really wanted to stop botters I would make sure I didnt have an easily detectable pattern of detection that botters could adapt to. I'd make sure that my bot spotting staff/systems let a lot of 24/7 botters slide under the ban hammer. I'd also make sure they hammered anyone levelling new bots on a brand new account. I'd leave a few long term botters free to bot as much as they liked, whenever they liked. I'd basically mix things up so much that I could laugh my socks off when I read all the futile threads and replies about bans posted here and at ownedcore.

And Lord knows theres plenty on both forums to keep me laughing for a very long time- it makes for compulsive almost addictive reading when I have to wade through countless crap threads to find golden nuggets of useful information. But hey, this is the internet and wading through shit comes with the territory.
