Does this mean you guys are getting a handle on what it was that triggered the banwave?

It could be the fact that the program is not disguised in any form while running in memory, and Trion's scans read it off, it could be that Trion is allowed to monitor your electronic communications while the game is running and people were on this website and ingame, or it could have been a random memory trigger ingame, but let's see what the dev's say =D

Exactly. As I said in another thread, Trion can put whatever they want to in their Terms of Service agreement but that agreement does not trump any relevant laws.

1) They do *not* have the right to monitor any of my electronic communications, other than those directly related to the interaction of their software with their servers.

2) Even if they did monitor webpage titles (which I believe Warden was doing at one time), my visiting a website which sells bot software is not proof that I have actually purchased or used such software.

3) In regards to #2, yes, Trion reserves the right to suspend any accounts, without reason or notice from what I've read. However, doing so without proof of a ToS violation would require a monetary refund for any unused subsciption time. You can't just sell someone a service then take that service away for no reason without refunding their money. If I pay for one year of cable service from my local cable service and two months later they decide they are not going to offer service in my area. So be it, that is their right. But they still owe me a refund for the 10 months of service that I did not receive.

4) If my account was banned and I was actually innocent of botting, I'd be wanting not only my unused subscription time back but a full refund of the purchase price I paid for the software. Hell, in this day and age where electronic goods have value, I'd prolly sue for the time I spent playing the game (all the time that I put into the game and I now have nothing to show for it through no fault of my own) and the real world value of any toons I had lost. Not to mention the pain and suffering of losing my toons, who I had developed a real emotional attachment to. Losing them was akin to losing a freaking family member, I tell you! Yeah, it's a stretch but I'd be pissed and we do live in a world where you can claim you didn't realize that coffee was hot and get a million bucks from McDonalds.

5) The one thing I *am* pissed about is not having access to my account at the website. They should not be allowed to block my access to that account, which effectively takes away my ability to remove my credit card information. I think this is what will end up getting them into a bit of hot water.

that was and will remain our first priority

We're waiting on the bot devs to try their tactics for trial and error. I can't say for sure, but i'd hope sometime soon.

I already have three more accounts ready to go..... Flip the switch and I'm off... Like I said to Hawker I have no issue "sacrificing" accounts for the good of the bot's future. Give me a set of parameters you want done, and I will follow it accordingly, then document the results. You need a beta team for this! =D

Okay, my update, yesterday i was told that my acc will be unbanned on Telephon, today i recieved an email where they told me, that i used a bot, that can prove that, but wont give me logs of that. Just for fun, i will consult my lawyer on monday and try to sue them. In a case it goes to court, and in front of a civil court, it will, they have to proof, that i used it and they have to proof how. That will take sometime and i have to spend money, but i dont care I have a good insurance i will tell u what my lawyer said and how it will end up in german law

Yea, gona swap servers since mine was already dead, gona bot 1 account but level my main legit, that and I am going to use some personal measures on my end to protect myself from being detected, just that much more =D
