I know that it is not same. But it is not your problem, that Blizz is using shady business to sell CD keys. Image situation, when you buy battlechest, try it to run on your PC and it will not run. You have right to return product (cd + CD keys) to seller and ask for full refund.

Yes, you can return the product in this case, but if you buy CD keys from random shady places, you can pretty much assume you won't get a refund simply because they couldn't sell that key again out of fear you might already resold it. Also, by massively playing using that key, you will end up not getting a refund because it no longer constitutes fair trial of the product. Those laws are in place to secure people against false marketing and making bad decisions that hits them financially because of being baited/tempted by marketing. In most countries that aren't using common law, it would be the intention of the law that matters, and that is clearly not to defend fraudulent behaviour.
Actualy, I can return it. There is part in our law, that say "you can´t return digital goods, if contract was fulfilled before end of 14d period", but since with battlechest you have 30d of GT, contract is not fulfilled before end of 14d period. But as with every law, without court it is hard to say who is right

You never know if you are right until judge will say how he thinks that it is. And then you can appeal and go to other judge, that thinks that first wasn´t right etc... That is reason why HB is still in business even that there is lawsuit since 2011

You can't, read my other messages. Laws have an order of importance, and a lower precedence law will never overrule one that is higher, unless the lesser law is explicitly written to cover specific areas that applies in a case. If you think the lesser law is in conflict with its parent, you would have to test the validity of that law in court. But then again, the main difference between common law and the legal system in most of EU is that courts decide on intent, not absolutes.
