What an usefull answer. I dont give a shit for their "policy". People have paid for their service and if they wanna shut it down people has the right to know why. "Our supervisor has looked at your case again bla bla bla".. F*ck your supervisor! I wanna see some proves.

I got a mail this night telling me that im banned. Can you tell me what im banned for?

Cheers

It's a copy / paste response. I work in IT. I have plenty of these templates in my ticketing system that I use for the level 2/3 cronies who try to send tickets my way.

Just keep sending emails, after about 10-15, id start calling. Eventually you will get someone.

I know its template. I ask for a reason and they re watch my case. Tell me what the fuck im banned for.

Its like the cop take you down without telling you why. "You go to prison for 100 years. Why? Because you broke some of our 1000000 rules, bye bye".

Lol... ask them if they are using a bot to answer tickets. rofl.

ya mayb using bot is against their rules, but how we know they really caught us on it?
really not possible to get the prove from them?

What would happen if someone would go to court against blizzard because of a ban? Wouldn't they then need to proof it and reveal how it was detected?

You know you botted.
They know you botted.
What kind of 'proof' do you need?
Once you start botting, you know that eventually you will get caught.
Be happy that they are lacking manpower to look thoroughly through all obvious bot-like users.

You don't get it do you? If we knew how exactly they detect bots then we or the DB devs could change/adjust whatever they are looking for and thus lower our ban chances.

Duh... even if someone would sue Blizzard for banning their bot army, why do you think detailed proof would get released to third parties?

I'm not sure about the law's that govern your country \ state \ city, but where I'm, Blizzard would be within their rights to refuse to give out a reason why they banned an account as they could claim that its to protect their intellectual property. That being said, there are 9 or so major legislative breaches with their contract (terms if service) that significantly breech consumer protection law's. I'm not going to give out all the details in here, however I would strongly suggest people read their countries law's in regards to entering contracts....

Play particular attention to things like:
* When the exchange of money occurs vs being given the contract terms
* Conditions such as "Blizzard can change and update these contract terms when it feels like"
* Notification of changes in contractual terms & how they must be given
* Contract Terms that are weighted to significantly benefit one party over another
* Ambiguous contract terms, with failure to explain them in plain English
* Stating that Blizzards country of origin...e.g California laws apply over the laws of your country
* Misleading and deceptive conduct regarding the product (lack of PVP functionality)

The complete way blizzard does business in my country breaks a substantial number of major law's.

Its quite easy to google your countries \ states \ city's sales law's and apply them. I would strongly suggest that everyone who has been banned does so and takes the time to write an e-mail to: [email protected] and points out in public forums the exact way they are breaching the law. It might be a complete waste of time, and you may never get your account back that's been banned, but the more public pressure that's applied, negative press combined with more people knowing their rights and clearly defining the ways that they are breaking fair trading & contractual law's will go along way to making them think again about doing "Mass Ban Waves" or banning accounts outright without giving warnings first (as outlined in their Account Penalties Terms & conditions)

https://eu.battle.net/support/en/article/diablo-iii-account-penalties-policy
https://us.battle.net/support/en/article/diablo-iii-account-penalties

The fact that they have banned people without giving a warning, final warning, or anything like that is a breach of their own contractual obligations.... also if you look at the wording

Account closures are rare and are typically only provided after a final warning, except in the most extreme circumstances.
* Banning 7000 accounts on one day, does not appear to be "very rare"
* Must be given a final warning, except in extreme circumstances... there is no definition of what extreme circumstances are therefore without a clearly defined list of whats considered to be extreme its illegal for them to take that form of action and they must give a minimum of a final warning first.

Live by contractual law, die by contractual law....
