New EuGH ruling on selling a licences for software / 3th July

you could "sell your license" and transfer it to a account but they could take away your toons in theory i think right?
 
sure you are correct about wow-lizenses?
imho the key that you purchase for wow isn`t a license for the software. you are free to copy and give away the software as much as you want. the product key is an account key. no software license. and this account key does not fall in the here given EuGH cases.

example: you buy a membership for an adult website. the software to view your mastrubation movies is sellable now (internet explorer, firefox, whatever(in blizz case the client software)). the memberschip for the website is not resellable (same as the wow account key)
 
so all in all selling a b.net account seems to be "allowed by law" and can not be prohibited by any TOS (in europe)
if blizzard would suspend / close an account due to selling, you could first contact the customer support and refer to the judgment.
and/or go the way to the court....

If Blizzard decided that they had to randomly delete your characters that would be fine too since it still belongs to them.

Your Characters / Items do not belong to you, you just get to play with them once in a while :)

Same Reason that when you make an RMAH sale they can still not pay you if they want to, aka when your account has been compromised :)
