I would still recomend others to file complaints with the BBB. They and the public will take notice if you take action. I am contemplating taking them to small claims court in my local jurisdiction which is far from Blizzards HQ. I sincerely hope they send a lawyer out and spend money on this even if I loose.

Personally I see no reason to do anything to blizzard. I am the one botting in their game and making a profit with near zero work involved. When I get a ban I just take it and start again with the gold / money I save for just that scenario. Unless blizzard is doing something illegal on my computer to catch me I really do not care when I get caught. Each time I have made a very nice profit before getting caught and see no reason to fight with blizzard when I am the one breaking their rules. I do not even put in tickets to try and get unbanned.
