Legal or non legal Blizzard wont tell us ban reason?

If you ask why you got banned you wont get an answer. They will send you differend templates every time you answer them

Is it legal action? Can they ban people without telling them why and not show evidence?

They can ban entire game and due to their "own policy" they dont talk about cases. How can that be legal?!

I have the right to see evidence as i have paid for a service. I ask them what i have done but they wont answer, they just give a random answer.

How can they do this legal?
 
If you read the TOS they can ban you for any reason without justification, it's legally binding because you click accept, they own the account not you. You blotted you got banned , there's nothing you can do about it.

You stupid ****. I have an account i havent botted on that banned to. The reason why i ask this question is not point that i NOT guilty, but our rights. I dont give a damn for what country you might live in. We have paid for their service and then we have the right to use it as the rules say. I have the right to know how they found out i botted and their evidence.

Maybe you live in Africa where all is so tuff. Move to Rusia or Italy, you sound like a hardcore Mafia.

If the police come and grab you without telling you why i then enjoy the banging, cuz we are some that dont let people butt rape us without proper reasons.

if i make you sign a loan that says i charge you 75% interest, yeah i signed it, i dont pay you, you take me to court, the judge throws out the case because youre interest rate is 1.) inhumane 2.) stupid 3.) ridiculous

blizzard can do whatever they want, except when they do have to prove it, they wont because they will prove they broke the law by the level of scanning their "detection" system did.

theyve been sued before and lost, they did it once u think they wont do it again?

Your on this forum.... you botted.... your got caught.... and you want cookie? Of course it is legal, you signed their ToS when you ticked that little box during installation and certain updates.

dont listen to the consequentialists here if your belief is that you deserve proof i certainly understand that, and they could do it in a way that did not compromise giving away their bot detection strategies. perhaps a date and a time, or the route the bot took, or even just say "you were using demonbuddy". something that is true and shows they may very well have legitimate proof not obtained from something that might be reckoned to an illegal search. yes they can take your account away at any time for any reason because of click through term/agreement contracts, but all of those terms are subject to dispute as per their dispute resolution policy. (and that may not even be their biggest weakness)

watch the video of paul sams their coo talking @ ucsb (santa barbera) on youtube. this is their legal head for contract related stuff so you can get an idea what you're going up against.

I can assure you, if I win the lottery one day, I will take blizzard to court and ask them how they managed to figure out you are botting. Until that day, suck it up I guess.
 
Actually I ran it past our contracts lawyer at work. He said in New York that their "agreement" that you click on is not legally binding he said he found more than 20 things in it which would make it null in NY. Furthermore he said that it is an implied contract, and that neither party can null or end the contract without specific proof. Meaning botting is a reason to end the contract. Just saying you were using 3rd party software is not good enough, they would need to provide proof of your botting that would hold up in court.

He said what blizzard has is that the cost of having a lawyer bring it to court would far exceed and returns, at most your purchase price for the game, basically who would hire a lawyer at $100 and hour to get $60 bucks back.

His suggestion was to go to small claims court. He said almost certainly you would win because it would cost Blizzard to much to deal with it. So you could win and then try to collect your $60 (or less) back. What it comes down to is even though it's $60 it's not enough to make pursuing worth while.

We can all wait for the class action suit and collect a $5 coupon for our next blizzard purchase.

Blizzard is lazy and low on staff members, so they came out with a in-game reporting system.
this is how the do things now.
1. server info corruption detection. in some cases it can be a final warning 3 day suspention / or account banned.
(in rare cases you can get your account back, if there is Proof you were hacked. by a website/email/advertisement key logging scam and there is multiple complaints.)
2. A small Group of players reporting you = 3 hour suspention
3. A massive amount of players reporting you = 3 day suspention


sort of made up that info above, but it seems true.

first of all, it depends on your country?s law.

so nobody can tell you an exact answer since law and especially consumer rights vary a lot.

for most cases i would say "they act legal".

they disband their service because you broke the agreement, if you want to force them to

- reveal more details
- reenable your account
- refund your costs
- what so ever

because you think they may act non legal in terms of local law, then feel free to sue them
 
ask blizz tech support, they will reply, yes we know you used a third party program, if you want to play, go buy our game again sucka!
