So My account was banned on 23 January and I stopped playing the game. I appealed it a few times before getting the old 'penalty has been upheld' message.
However I got this on the 21 Feb. I thought at first it was a scam, but I logged into bnet and my account has indeed been restored complete with my 98 paragon character.
