It depends on how much information was given to the buyer (scan of the passport and cd-key of the game).
If the buyer has all this information then conflict is likely to be solved in his favor (because he will has the latest e-mail and password)

In this case, that buyer has access to the one piece of ID you have provided them with. That's when you submit another piece and demand the "buyer" do the same. You win.
