Does Blizzard have proof of people botting?

Im going with the other guys opinion.... They gonna wait till everyone buys the expansion and then ban all botters, personally i only have one acct that i bot to gain paragon lvls about 12 hours a day, was never in it for the money if they ban me ill just go to path of exile no biggie.

Taking into consideration that most of currently playing characters are botted I really don't think Blizz will wait for us to buy expansion before banning.
They are still giving bans - more or less, depends on their mood I guess.

Reading through some topics on this forum and other pages it looks like they targeted - at least so far - people that were selling items on RMAH or trafficking gold outside of D3 borders (ebay etc.).

Some of my friends are using DB just to level up some characters or to get paragons. They are just fine. However 2 others that were selling gold and items on RMAH got banned around christmas with this massive banhammer.

In short - I cannot second your opinion about banning after we register expansion on our accounts but I guess we'll see in a year or so ;)

Yes, please, sue them and pay for everything when you lose :) at least we will know if it goes or not : PP

Behavior logs, hours, how repetitive your actions are compared to a bot/real human, your running tasks list, a screenshot of your desktop, but then... It makes me think... The proof doesn't matter. Ever heard of the employment at-will clause? Every job in America except for jobs in Montana are assumed to be employment at-will, unless otherwise specified on the job offer. So basically, your employer can terminate you for any reason, or no reason at all. In this case, Blizzard probably has this similar clause built into the EULA. They can ban you for any reason, or no reason at all.

Which would be kind-of okay, if you could still use your 60-euro game after said ban, even if offline.

they will counter sue you so hard you will be bleeding out your ass before your case is in court :D
dude, Blizz is established in the land where you can sue someone for farting too near you, of course they are prepared with inconstentable evidence for angry kids (no offence) trying to sue .
unless you have a team of lawyers of the same calibre Blizz does, dont bet on your 0,01% that they will actually find something against your "super strict" consumer protection laws. Make no mistake if youre from Europe, they know your laws better, than your own countrymen :D

yep, they will hit with the hammer in 2-3 months after the EXP goes live, to make botters have to buy their accs again. its an excellent strategy really, cause botters dont mind re-buying those accs as long as theres a steady demand for items/gold. now the current banwave was unjustified, because imho Loot 2.0 coming this year (presumably) kinda makes the current market dull, botters are not likely to fully re-stack their accs, gold prices will sky rocket again, and demand will narrow (who's gonna buy chinese gold for 5USD a billion in Q4 2013?), and the RMAH has already been dead for a while.

If to listen you then we have to think that Blizz have a team of layers-terminators model T1000. Hey, friend they just a humans like we are. And they can also do mistakes.

Liebeck v. McDonald's is good example.

IF Blizzard looses the case against a consumer
AND Botting is allowed
THE GAME is going to go to shit
BECAUSE everyone will be botting :)
anyone thought of that?

I think that much better to create games where people will not be forced to bot. Bot appear always in place where you must do same stupid actiona over 1 mln times

True, but then again, if you aren't forced to farm, what are you going to do in that game? PvP all the time and get your stuff through some PvP reward system? Think about it- all the best games had a LOT of farming involved in them :) diablo2, lineage2, WoW whatever.

Furthermore, even if you made your stuff through PvP it still be farming... what would that game be, where i am going to play 12 hours today and you are going to get in for 40 minutes and at the end you will be more geared than me. Or, not "geared", but accomplished in whatever way the game requires. It is unnatural; experience always meant something, in games or sports or work or simple everyday life. Chances are, if someone does it longer than you and does it more than you, that person would be better than you. There are exceptions where extreme talent is involved, but these are so rare..

This is the real reason behind botting's success- it gives you more experience in the field of the stuff you bot, so to speak; and that always leads to certain benefits- in D3's case it is more items and thus profit.

Yeah. I understand your oppinion. But look . I am (and not only me) 35 years guy who have wife , children , job, tennis , friends etc. I cannot physically spend a lot of time for game. In diablo i play mostly by tradition since d1, d2, lod etc. But instead of relax i get tonns of crap on the ground , tons of rare items which so crap that sometimes white item better than rare. I am happy that Stupid idiots in blizzard started at least to understand . And i am happy that at least they started to create Loot 2.0. I think that botting in D3 appeared because they tried to make WoW from Diablo. Endless game. I think that good balanced game is game possible to finish on hardcore without auction house for average player in 50-80 hours of gameplay. In current diablo it not possible for average player. I not tell about super fanats.
