You apply to the TOS / EULA the moment you buy the software from the store, because there is no EULA or TOS attached to the product, you did not accept any other TOS / EULA but the merchants one.
Thats common sense in Germany. You can not sue anyone in terms of TOS / EULA, when there was never one.

Isn't it a TOS / EULA that pops up when you first log into an account?
the only popup i got was low tire pressure...next time you buy a car, and try to start it, wait for the pop -up on the display where you accept the TOS / EULA of the car company, that you can not sell your car, and you can not drive your car with blue shoes!
