Can't purchase new key, but can we upgrade existing ones?

"Distribution" is not licensing, and licensing is not "technically" distribution. It may seem that way, because you're probably thinking "I'll share my key with a buddy" which legally you're not suppose to be doing as a licensee, but at the same time multiple sessions are probably tied to the same IP as the first when you sign in anyway, so it wouldn't be possible.

To add: I'm simply trying to give them ideas/questions to ask their lawyers, it never hurts to ask, and everybody has something to gain.

Pretty sure they asked all sorts of questions to their lawyers when HB got hit first.
This isn't their first time.
Obviously upgrading your session is like selling since they will be receiving money.
Is it that hard to grasp this fact? .... :/
 
I don't really understand the point you are trying to make. You bought a trial of the product. Trial is over. If they give you access now it would be a separate transaction which they have stated they cannot do and justifiably so. If you don't think blizzards lawyers, which are probably some of the most knowledgeable on the particular subject, wouldn't be able to use this against the buddy team I'm not sure what to tell you. I would imagine the buddy team prefers to do what their lawyers believe is right vs what you think is legally acceptable.

I don't recall saying I've purchased a "trial", but that was a nice way to open with bullshit attempting to valid your rant.

In your sad attempt to sound competent regarding law, you would be correct if I owned a trial that has since expired, but that isn't the case and was never made out to be.

Sorry made the wrong assumption. Replace it with 1 session license or whatever you have given that you didn't state it. Still a separate transaction. I made no attempt to sound competent regarding the law. That's what you are trying to do.

Sigh... what's with you people? Just because they would be receiving money by enabling additional licenses for existing customers doesn't equate it to distribution. By your logic, the fact they're still supporting the product with patches and "distributing" it means they're violating the terms of the injunction; which they're not. That example is more borderline than them authorizing additional licenses, because there's nothing in regards to distribution in doing so.

A license is simply additional access to a product you've already purchased.

We own the product, they can support a product we already own, allowing an established user access to additional content (patches, plug-ins, licenses) isn't considered distribution.

If their lawyers feel it is, they need to find new lawyers.

This debate easily turned into 3 pages and we are just a small group. Not a good sign regardless. Too much work to be at risk at this state and at this time. You can wait less than one month. I am sure you can.

Exactly, which is why I fail to see why you would bring up another topic. Why can't you just be happy with what you got, and finally get it in your thick head that distribution is closed for now? Doesn't matter how you do, upgrading current sessions or buying new. They will still be opening a new session for you, which is distributing. I fail to see how you can be so thick?

So by your logic, when they made the NAV servers available again, they essentially redistributed thousands of keys? Fucking genius, go look up the definition of words before you attempt to contribute to the conversation.

"Upgrading" is an expansion of something you already own. (Same as a patch)
To "Buy" is acquiring something you previously weren't in possession of.
They can't "Distribute" something to you twice. Only broaden the accessibility, which is at their discretion. (as a fee; giving you extra features, not a new product.)

This is DISTRIBUTION of more copies. If you do not understand this I would pity you but you really are to naive to even bother with.

You're a fucking idiot, what if they said "fuck it" and enabled an all access stand alone program with the next patch? Nothing has changed, they just gave away/made their product open source. What happens thereafter wouldn't reflect on them.
Actually at that point they are breaking the conditions of the injunction. They can not distribute to new customers. Even if they changed and made it 100% open source, they could not post it, or give it away. They would have had to do that BEFORE the injunction.

You should go try and be a shit house lawyer some place else. Because your mental capacity for law just seems to be well diminishing with each post.

wrong, because the key limits how many copies can be used at any given time. Letting more copies run on same key = more copies running at any given time = distribution
 
We sell keys for 250,016 euro each (16 euro + 250k euro fine) - including the 'upgrades'
