The interjunction was done without a hearing, according to the scan I saw. There are a gigazillion ways to legitimize this bot. As I already said elsewhere you have movement impaired people, that want to automate things, obviously. Then you have the problem of handling. There is a ton of other softwares, even older then D3 out there. This law just isn't applicable and I don't see the judge going in blizzs favor. If at all they interjunction was just made, because it can be made.
