you know whats sad?


My character had ALL his gear beforing, during, and after the ban wave....


1 week passes


i go on diablo progress... all my gear is there


i click battle.net armory.... my weapon is gone.



obviously blizzard put my weapon in the AH? or maybe one of the reps decided to use it on his own barb...

sigh we need to do something about blizzards illegal process scans, im sure if everyone on this forum pitched in 1$ so we could have an attorney look at the TOS and EULA we would easily have a class action lawsuit


Simple. blizzard cant prove how they detect hacks.. why? because if they do they will prove theyre breaking the law and fuck themselves over... why else do you think all we get is closed support tickets with copy and paste message

we are dumb to them, but when you contact the legal team, shit gets real.

activision blizzard = lowest scum of the business world making 30% taxes and stealing from banned bot accounts what a joke
 
1. File paypal claim for all transactions within past 45 days.
2. File chargebacks with your credit card or bank for as far back as they will let you (in my experience 90 days) for all RMAH purchases.
3. Tell blizzard through ticket and through certified mail to their address listed on dispute policy website of your intent to enter arbitration.
4. Tell them since you did not agree to any terms of use or service (or eula) when you purchased the game, and when it was already installed you could not return it, you had no other option to use what you spent 59.99 (or w/e amount on) besides to click the accept button when presented with these terms.
5. File a complaint with the Los Angeles Better Business Bureau (la.bbb.org) for full amount in total spent on game and on rmah transactions, if possible include printouts of total billed in billing agreement on paypal and any credit card or bank statements.
6. Contact Blizzard through tickets repeatedly informing them that as the only route of contact to the account administrator, through tickets they must commence in negotiations for 30 days or forfeit (sever as per section 7) section 1. When they close a ticket immediately open a new one. After being ignored and/or repeatedly told that they will not negotiate or change the penalty under any circumstances, inform them that any response not explicitly mentioning intent to negotiate at all will be interpreted to mean they are (a) not upholding their own terms, and (b) effectively severing section 1 of their policy.
7. Warmly thank them for their help speeding up the process to enter arbitration and recovering funds lost in this gross breach of privacy rights!
8. Never admit to anything ever.

I think moving/accessing items is a whole different story then generating. There was a thread about a week ago adressing this problem - some guy said that after he checked his banned accounts he found that some really good items were missing while crappy items were still equipped.

It's a good try... one thing tho..

2) You agree to TOS/EULA when you purchase the game digitally or when you attach the game to your account from a phyiscal purchase.
3) You agree to TOS/EULA after the first patch you download and each patch there after subsequently.
4) They log every time you click "I accept".
5) The "forced" to accept is not in affect here. If you do not check the box, they will not let you install. Furthermore, they explicity state what it means to accept it and that you have the option to cancel installation. They also tell you in their TOS that if you disagree with their TOS, you can receive a full refund of your purchase =P.

Blizzard has lots of money and lots of lawyers lol.
 
I do not see any benefit Blizzard would receive through doing this. You can still access your Battle.net account history to see if the items were sold through the RMAH (either paypal or battle.net account). If we were going complete foil hat, they would create the items and launder them through the banned account lol. Mo items mean mo money. I'm not going to respond to this thread anymore. My head is about to explode with all of the people that fear Blizzard's CIA connections ever since the banwave. The theories are getting more and more outrageous every day.

I sold $100 worth of items and while they were processing I got banned and blizzard never sent the money to my paypal. What could I do about that?

I personally called to try and get a refund in August sometime for a copy bought at Target, because I did not want to accept the terms, they told me I had to go back to the retail outlet, which would not accept returns on opened electronic merchandise. Therefore if I wanted to use the game as anything more then a frisbee I needed to accept the terms.

Regardless, (firstly) no terms/contract supercedes the law, and (secondly) the TOS/TOU have already been the subject of court cases wherein the terms where not upheld by the court, here in the US at least.

They may have money and lawyers, but we have the better business bureau and american arbitration association. All of their terms are explicitly up for negotiation as per their dispute policy / tou anyways.

(FYI- someone I am providing some advice to has had her paypal claims for all RMAH purchases in past 45 days "chargebacked" and the funds returned to her, and her mastercard the same except 90 days; just waiting on BBB to take care of the rest, and if that don't work then the AAA it is! Stand up for your rights, the law supercedes any contract.)

im sorry, but blizzard wouldn't put something on the AH when its digital, they can create one thats better by just coding.
but yeah man, that really blows. appeal and do something about it.

Care to explain that part? They OWN your Char, they OWN your gear, they OWN your account, you just pay for access to these things and the right to use them under very specific conditions.

You broke those conditions, they banned you from access - they still OWN everything and can do exactly as they please. Simple.

Similar if u have a car in UK.
You have no doc to prove you are owner.
You just use it.
Just leave them the right to confiscate if needed. :)
 
I must say I've never seen so many lawyers in one place. Everyone seems to think they know laws, after 9 years of mmo and nearly 2 decades of battle net you would think that if it was possible to sue blizzard for something by now someone would have. You should pull court records of all law suits vs blizzard. Every time someone has sued them they not only lost but forced to pay for blizzards legal fees and boy they are not cheap.
