I'm not saying they do see (or are able to see) what goes on with your computer, but the tou does give them permission to spy on the playerbase.
After reading this thread and considering all that was said, I have a bit more input.
I have a main bnet account with several attached to it, those were given the ban >suspension. I was on timeless isle farming epoch stones with a friend and pulled all I possible could. Sometimes Id pull mobs on other people as well. All that ended up doing was killing their mobs for them, not stealing their tag. This one person was angry because I was tagging and killing fast and he yelled at me a few times, I ignored him. This probably pissed him off more, I think he reported me. I was not botting on the account. And all three accounts on my bnet were affected
However. I have many more bnet accounts which I bot randomly and never for longer than I could stand to play them myself. I do bot on these and I was running two on the same computer while playing my main. So yes if blizzard scanned my computer they saw HB up and running.
Lesson learned: Do not bot on the computer you are playing your main on, even if the bot is attached to a different account. Get a vpn too. dont use your same full name on all the accounts and do not pay with your credit card on them buy game time.
So now, I haven’t botted since. I think using another computer and keep it separate from my main accounts computer would work. This should save my main account in the future.

It's in the EULA because it's something they used to do. Do you not understand what USED TO DO means ? They stopped doing it because it is illegal and violates several privacy laws. Now...I dont have the patience to write out a giant "How not to get banned" article...but I've read a lot of BAD advice in response to this.
1. You don't need a VPN...or a Proxy server...or anything like this...and this will do nothing to protect your accounts from being banned...the most this might do is protect your main account if you only bot on the others.
2. Reduce the amount of TicksPerSec on honorbuddy...You don't need it spamming 200 times a sec. 30 is plenty...hell, 15 is plenty.
3. MAKE YOUR OWN FUCKING GATHERING/GRINDING PROFILES!!! AND MAKE THEM FUCKING LONG AND COMPLEX!!! I cannot stress this enough!!! If you know ANYTHING about advanced Anti-Botting Techniques, then you know that they can look at "Heat Maps" to see the spots that people travel...So say your blizz, and you see that 1000+ people all travel the EXACT same fucking path...and not just the same route...but the exact same spots, 500 times over 8 hours? Now, while this isn't damning in itself, it can certainly FLAG your account as suspicious and they will eventually investigate further.
4. Just be smart...read other anti-ban articles...AND FOR FUCKS SAKE DON'T use the PVP bot unattended...You look like a bot, you act like one, and there's 9-39 other people WATCHING YOU BOT...it's stupid...don't do it AFK.
5. This is perhaps the most important....BE CONSISTENT! This is to say...if you play in 32-bit mode when you bot, and 64-bit when your not...red flag...if you normally only play 2-4 hours a day...but then all of a sudden you pull a 32 hour farming session...red flag...If you hardly even auction anything, and then all of a sudden you have 350 stacks of Netherweave Cloth on the AH....red flag...

You know the law in the US is whatever the fuck a jury agrees to it's different in europe especially in germany.you can put whatever you want on your TOS but you have to face any consequences it causes. If you kill someone according to your TOS, it's fine, but the family of the victim will sue you and you will be sentenced to something (Jail or even Death depends on the laws). Many ppl tried to sue Blizzard on this case, specially The Electronic Frontier Foundation that have labeled Warden as spyware. But they couldn't get anywhere. I say blizzard has the upper hand here. according to wikipedia Blizzard sued MDY Industries for making WoWGlider that they think it interferes with the game. The court actually awarded blizzard $6.5 million dollars.
This is the exact results of the court :
MDY Industries was liable for contributory copyright infringement for selling software that caused Blizzard's customers to breach their End User License Agreement and Terms of Use contracts with Blizzard.
As you can see the company has been found guilty because they crossed the lines of TOS

Dude, don't throw out advice when you have no idea what is going on. I have been botting for years now and never once renamed HB.exe or have gotten banned. I got suspended once WHILE botting due to my characters name and that was it.
The end result here is nothing really. Nobody knows what blizzard does to detect bots on the clients side, if I had to guess I would lean towards they dont do much minus looking for people messing around with the WoW program itself.

agbs do not stand above the law and if certain mechanics involve breaking standing law then when blizzard does this what breaks the law it makes them liable. they only put it in so they can use whatever means are not against the law.
so no blizzard can not simply scan my pc like some hacker because if i ever would find out i would sue them for whatever amount of money i could possibly get

They are well within their rights to scan processes and make sure that no processes are altering Memory in their program...WHEN YOU AGREE TO ALLOWING THEM TO DO IT...it just fucking common sense. It would however be extremely illegal if they did it WITHOUT telling you that they were...then you could sue their asses to your hearts content.
