no it doesnt matter, they can flag you anytime and ban you anytime. you can bot for 1 week, quit for 2 months then play legit and they still can ban you.

I had two Demon Hunters farming Sarkoth back in the days. After game limits were introduced they went inactive. After 1 month I checked the accounts to see if I should resume botting something with them, and one of them was banned. Even though it survived the mini "ban waves" as you call them. So no, they're not safe.

I have 2x 60 barbs untouched from July, I have a feeling they probably got the hammer lol. Might check today...
