What a bad behaviour is this? He botted, he got caught but refunding the money now is a really bad advice. What's wrong with you people?

I guess it depends on how you look at the issue.

At the very least, I'm a customer, if I have coins that I've yet to use on my account when it was banned, I expect an official notification and a refund for the unspent coins.

If I cheated Niantic, it doesn't mean Niantic can cheat me of what I've not spent right?
 
Delvestar is right, don't bother what this "BotOperator" is saying. As a moderator of a botting-forum he got a low self-esteem against these companies. The truth is, Niantic steals our invested money by banning us. Chargeback these guys.
 
...its pretty simple really...

I look at this from a cold American consumer standpoint, which is what the bulk of Niantic's customer business is:

I spent my money to get something,
I can no longer have access to what I spent my money on,
I want my money back,
I got my money back 100% guaranteed...

I dont care about fair or unfair - I am the Customer and I am Always Right (and the credit card companies, and Apple iTunes Store will make sure it is so!)
 
i spent 250$ for my main playing legit till level 25.. got tired and use gps spoofing till level 28 got tired and use this bot to level 30.. and this morning im permanent banned FML!

Niantic lets you play the game, you spent money, you fucked up and lost the game, why should you get the money back? You accepted all this the moment you began playing the game and botting.
 
Hey guys, my account was bannet too. But what is bother me is that sentence "Our goal is to provide a fair, fun and legitimate game experience for everyone."
What the hack are they talking about. This game is unfair like no other. I live in suburban from small town (in my region there are three pokestops and maybe 5 pokemons to catch). So I decided to use bot which give me the opportunity to get there where I couldn be.
So they are talking about fairness? Be fair, they are far far away from fair gameplay.

Fun, they are joking right? 5 pokemons, yes this is really fun, so much fun that I deleted the game twice prior I find out about the bots!

Legitimate, well we can discuss this, if I can play like someone in Central Park then I stop botting, but for now, I have no other chance. Oh wait the minute I can take a vacation, pay for ticket to NY, pay a taxi to Central Park and pickup all pokemons, visit all pokestops in train in all pokegyms. But who ensure me that I will not get banned?

So first you repair your software that everyone have the same changes, then we could talk about fairness.

Maybe, if they had their stuff together and they didnt release a sloppily coded TIMESINK of a game without adequate content and variety, that isnt region balanced (urban vs suburban), people would not even bother with bots?!

That is the single worst analogy I have seen in my entire life. If you want to use banks as an analogy then it would look like this.

Bank allows you to open an account with them free of charge.
You use the account for years without any issue.
One day you get a parking ticket outside the banks location.
Because you broke the parking rules outside of the bank you cannot withdraw your funds from your account.
Better not break the law next time.

Your wrong. The bank and the parking-space is monitored by two different management (police vs bank). However Pokemon-GO is run by one management, Niantic. We pay Niantic for certain services, for example to spend poke-coins for egg-incubators and pokeballs to enjoy the fruits of those spendings. It's a agreement of spending between you and Niantic. If Niantic breaks that agreement by banning you for their ToS, they should give you the money back, otherwise it is stealing.
The spending-agreement is staked higher then the TOS because Niantic is not allowed to sell to customers who will be banned within the time-period of buying coins and enjoying the fruits of your coins. It is known as fraud by a company.

We're all entitled Americans, would you expect anything else? Also, if the company does not communicate anything with the customer, the customer is only speculating what happened to them. So really, it's on the company to communicate that they have banned you to ensure you do NOT dispute any charges.

Otherwise you are saying we should allow them to take our money while we can't use the game? We didn't get informed by them to let us know that is why we can no longer access our account.

If you were a legit player caught up in the ban wave, you also wouldn't know.

I do not think it's fair to expect players to wait in limbo and just leave their money on the table without confirmation one way or another. It's a crappy way to run a business. Hell, even small companies like MyGoBot posted on their site they were closing. Niantic is making MILLIONS. They should at least say something publicly.

Finally, every news organization has only quoted their website or ToS. No one has gotten an answer. So for that, fuck Niantic.

I made a 2nd account a few days ago and it just got banned today too.

Yes, same here. I created an account 2 days ago.

- no sniping
- no tools other than Pokefarmer
- 'careful' botting (meaning slow walkspeed, not 24/7, no large jumps)

Permabanned as today.

So for now Pokefarmer is detected and we're getting bans even if we're botting carefully.

I will cretae a new account right away and see what's happening.

Mr Mod, might I suggest you use a non mod acct for your PERSONAL opinion? Or am I to think that the main company here shares your opinion?
Sorry but I used to be a forum mod for AoL back in the 90's, guess what...I got reamed by my bosses for using my aol mod acct to share support for a fellow poster. IOW, I got told to use my personal acct to support a fellow poster on something, not my fricking MOD acct.

I have 2 possible accts banned right now, 7 others working as of 2am eastern this morning. I plan on botting the crap out of Niantic in a few days. I have no problem creating a crap load of throwaway yahoo, aol & gmail email accts then doing the same on the ptc & also the google/gmail accts.

A free game, hell they are already killing themselves by blacklisting broad swathes of ips & yup I used to do tech support too. Cant wait to see how many non botting players start bitching & dropping this crap of a company in the next month. Least Blizzard actually has a decent game with decent servers, something Niantic should have already corrected with all the money they earned in the first week or so.
 
If you want a Bank analogy take this one:

You open an account and get a credit card.
ToS say they have to be even at the last day of every month, otherwhise you can't withdraw any money anymore until both are even (soft ban).

After a while they change ToS with a short information "Hey Customer, we changed our ToS, check 'em out!".
New ToS says, if your account & card were ever not balanced at the 25th of every month, they can block your card for as long as the want or forever and maybe also cancel your account (hard ban).

How the f*** is this ever legal? Even if they are technically right and you had times when you hurt the initial tos (!), I know not a single case where this is possible.
And yes, they changed the ToS for that.
 
In all honesty it does not bother me so much about getting banned..what bothers me is the way our accounts are treated for a ban.

A developer creates a tool that people like myself use because i live in a area with 2 gyms and about 5 poleatops.

Developers get contacted by the game devs with a cease and desist letter to stop development and deployment of their apps. They get a warming and must respond in the timeframe saying ita done.

Us players who use the tools the developers created get shafted with no warning.

if developers who create the tools that people use to cheat with get a warning to stop, why dont us players who are flagged not get a warning saying our accounts were flagged for not playing fairly, giving us the option to stop before a perma bad is issued.

sure we may have all the top pokemon and a killer team of creatures, but devs are making money from tools like this. I am a paying cuatomer for pokefarmer and im not putting anyone under the bus, it just makes no sense why devs who can make money are given fair warning vs us as customers who spend money on the game get no warning and just a perma ban while game devs run away with our money or items we purchased.

not debating any refund options, just saying if fair is fair then why does devs getcease and desist warnings and paying customers of the game just gets perma banned with no communication at all.

Thats my rant for the day...
 
I agree with some of the above posters. If they had any legitimacy as a company, they would fix their systems to at least notify the userbase of whats going on. Blizzard's model works great. Awesome, anyone at a decent level now is getting reported and banned, no point owning gyms. I'm so done with this game, I'm just botting accounts cause its free. I got to level 27 on my last one, banned.

Niantic will never get another penny out of me, I got some enjoyment out of the game, but I am over it. Games dying in my city already, the parks used to be RAMMED full of players, it gets less and less every day. I used to see kids playing the game constantly walking around, thats stopped too. Niantic is shit.
