It bothers me that they didn't identify any evidence of your botting or the bot itself. They could be just looking at suspicious behaviour and calling it a bot. My understanding is that they cannot inspect your running processes and cannot tell specifically that you are using HB. Correct me if I'm wrong.

Mythbusted, thanks. So we can conclude that Blizz knows every bot we run and allows them to run presumably as long as we are not negatively impacting others' gaming experience (ie. exploiting the economy).
 
Not necessarily, they may check only after a gm asks for it, so when you are reported the gm checks you, BAM banned.
