i almost did that lol, got like $1000 worth of gold off my accounts before my court date though so i didnt go through with it.. u can file for free if u dont have a job but its only like $20, the only problem is showing up in california. it would have been interesting to see what happens lol.. i dont think anyone has tried it before, but either way it would be a kick in the nuts for blizz just for 1 person to show up
can file online here I-CAN!™ Legal Small Claims E-Filing Page
or you can keep a vanilla account in your guild which is inactive with a high enough rank to move gold off. after you're banned, activate gametime (RaF works as you'll only need a few days) and move all of it.btw in case u wonder how to get gold off your account after u get banned, keep it all in a gbank and after 1 month an officer can take over as GM, just make sure someone you trust is an officer.
i tried that, they banned the vanilla account too, i had ALL lvl 1s on the account and NONE even left the starting zone or touched any goldor you can keep a vanilla account in your guild which is inactive with a high enough rank to move gold off. after you're banned, activate gametime (RaF works as you'll only need a few days) and move all of it.
if you filed in small claims court what would be your grounds?
They "took" your money sure..that isn't good enough..
You paid them for a service..the service of renting you your account for as long as you choose to pay for it & they choose to provide it @ their discretion & no one elses..
After paying for & receiving said service you violated the terms of operating & fair use within that service..decided by them @ their discretion which is also well within their rights..
They didn't take anything from you..you were provided with the service you paid for until such time you did something you agreed not to under penalty of whatever Blizzard feels like doing to you including removal from the game environment..
haha i didnt start it, but look who it is.. one of the botters who flames the idea
Blizzard can be all powerful and have the best legal defense team, doesn't mean they can stop multitudes of filings in court. The costs involved in setting up a defense, flying a lawyer out to the area they are being sued, paying hotel, car rental, food, etc... for that lawyer... You add it all up and then complain about how this guy is saying he wants his gametime back... He is going to win unless blizzard likes to waste money to prove a point... But that's NO ONE's call. I doubt they would fight a small claims court filing based on the simple fact that the costs involved are much greater than just losing.
Probably said before, but if everyone banned filed in Small Claims to get their $40 back it would overwhelm Blizzard as they have to show up in person and cannot send an attorney. LOLz
Long live HB & GB you guys are awesome!!!
So you'd go into court without preparing at all or having constructive..critical conversations with peers about points the opposition may make attempting to crush your claim?
You & I disagree on what constitutes flaming to an extreme degree..
If you plan to just stroll in there without considering your opposition..pretty likely you'll underestimate them..
While you may have valid points to make that sound good in principle..under the harsh scrutiny of a courtroom..they may not hold as much clout..
If you did find yourself in court arguing your case for those 4 game cards bought with gold..what would you say when asked how you paid for those game cards?
If you admit it was with gold & don't see the problem..what next when asked if you under the penalty of perjury were aware doing such a thing is in clear violation of detailed outlined terms agreed to when entering into your business agreement with Blizzard?
This here..what I'm asking you..is what conversation is..just because I'm not agreeing with you..doesn't mean I'm not interested..I want to know your angles so I might elaborate on where I find them lacking..at the end of the day either bringing up a stronger case hardened with feedback from your peers..or an understanding that you're grievously outmatched..& maybe it isn't worth the time & effort you plan to put into it..
