So I had one of my characters restored. I logged back in and noticed that the GM's must have really screwed up. I have around 2k haunted spirits now. I have been trying to sell them but they are so rare someone will eventually notice. They are going for around 600g each on my server. I have been trying to post no more than 1 or 2 per character and I have 7 or 8 characters that I am using.

The fact that a GM gave you too much of something during a restore is not a fault of yours and cannot be held as a bannable offense. That being said, they will yank them away from you soon enough if they find out you have them due to a mistake so keep that part to yourself as much as possible.

Although I would avoid posting dozens of these in the auction house on any one toon at the same time, you should be fine doing what you are doing. You could even post in trade chat that you have a Haunted Spirit for sale...just don't say how many you have...and sell to everyone that way. The only reason a GM would notice that a mistake was made is if someone complains about you and they look into the historical records. Don't try to sell in excess and you should be fine.

You should also look at it like this: The GMs messed up and gave you too much, but you failed to report the mistake, so in turn you're exploiting a mistake made by a GM. They can ban you for that. They'd probably say they banned you for exploiting the game. People have been banned for this because of gold in the past, so I'm sure it would happen for something so rare. Just be careful. If you get caught, you can't deny it because they have the records to look back on. Just sayin'...
 
nah, don't think they would ban you, its their mistake and they have this sort of policy of not keeping you accountable for their mistakes, but they would definitely take everything away + a report and investigation could lead to some boting if you are doing that kind of stuff.
They could ban you if they want though, they could ban you for any reason or none if they want, but the way you are doing it is good, you will pass unnoticed and be fine.
 
Simple Answer: Yes, this is bannable

No matter how you look at this, the grey area with blizzard is irrelevant.

You are exploiting something you know to be wrong.

Think of it like this:
World firsts where guilds used an 'exploit' with a ledge or something like that, were BANNED because they were abusing (although what was not their fault) the game

Not their fault blizz made that ledge, doesn't matter, they used it KNOWING it was wrong
