Worst case scenario (Copyright infringem

So, I was thinking about running more assisted games. I wanted to know, what is the worst that can happen? Can they only ban you? Or can they go after you for copyright infringement? According to the EULA in section 2, they say it's copyright infringement. Can they hold us to that for using demonbuddy? They can not go above the law, also they say in the latest EULA that they can read your RAM. Can they see demonbuddy in the RAM?
Things to consider.
1)Blizzard gets a cut of all RMAH sales
2)I've never heard of anyone going to jail or paying a fine.
3)Demonbuddy doesn't use code from the game therefore, i don't see how it is Copyright infringement
4)Sometimes people get reported for botting and blizzard ignores it on the forums, they do not offer reporting in game for it either which seems to suggest that are informed about it and do nothing about it. They are getting a profit from the RMAH sales which seems to be a bit shady in my opinion.
