I am surprised they said that.. but that is hard one I second what Hip said. Although if we sign the TOS then it probably makes it legal to do so.
You can agree to giving away your first newborn in order to log into the game, that doesn't make slavery legal.

Theyre anti cheat statement on battlenet clearly states if you agree playing the game, they MAY do that, if you compare
that to slavery, or privacy intrusion, i think your one bridge to far.
Im pretty sure theyre legal case on that, is the same as some websites, they store your email, but
wont sell it or use it for anything else then what you agreed to. They watch your ram / processes, but only scan for
known programs against theyre policy, not like they will see a list what you run in background. If x=1 (ban)?
If they want to acces your ram / processes, they can. And i wont say nothing for sure no more, since i
got perma'd on first offense today, but i think <-- they do it!
