I just got round to logging in for the first time since the patch and noticed a section in either the EULA or TOS (I can't remember which one) saying that by accepting it we give them consent to scan our RAM while WoW is running to see if they can detect any 3rd party programs running.

I'm pretty sure this is a new thing as it was capitalised.

How is this going to effect having HB running in the background ?

Consent to Monitor.

WHEN RUNNING, THE GAME MAY MONITOR YOUR COMPUTER'S RANDOM ACCESS MEMORY (RAM) FOR UNAUTHORIZED THIRD PARTY PROGRAMS RUNNING CONCURRENTLY WITH THE GAME. AN "UNAUTHORIZED THIRD PARTY PROGRAM" AS USED HEREIN SHALL BE DEFINED AS ANY THIRD PARTY SOFTWARE PROHIBITED BY SECTION 2. IN THE EVENT THAT THE GAME DETECTS AN UNAUTHORIZED THIRD PARTY PROGRAM, THE GAME MAY (a) COMMUNICATE INFORMATION BACK TO BLIZZARD, INCLUDING WITHOUT LIMITATION YOUR ACCOUNT NAME, DETAILS ABOUT THE UNAUTHORIZED THIRD PARTY PROGRAM DETECTED, AND THE TIME AND DATE; AND/OR (b) EXERCISE ANY OR ALL OF ITS RIGHTS UNDER THIS AGREEMENT, WITH OR WITHOUT PRIOR NOTICE TO THE USER.

oh no

I remember reading something about this in the past but thought that they were limited only to scanning WoW, this reads like they can scan anything.

The thing that worried me was that it was capitalised in the EULA and I was under the impression that signified that the section was new or changed.

Here's hoping I'm wrong !

I believe they are allowed to only scan memory addresses at which the WoW client resides in (the wow.exe process).
I remember a few years back Blizzard caught massive amounts of flack over warden scanning external processes.

I believe it has been there since just before the Sony rootkit/Glider banwave sometime about June of 2007. This gives you an idea of what Warden is doing in the background. It has been discussed of Warden scanning RAM, internet history, and more. You are given them consent to do all of this, but no one really knows exactly what Warden is monitoring...

Not to be the devil's advocate but do you think anyone can "monitor someone else's COMPUTER" as well as he/she does someone else's RAM?

Didn't Hawker already state in a interview about the law suit that he THINKS blizzard already know who is using HB and just not banning them? Could be wrong tho. And I wouldnt think twice about how warden just sends the info to blizzard and dosnt auto ban. And blizzard dosnt ban unless you start selling gold or abuse the economy so much that they it's effecting the game play of others.

Just a thought. But blizzard is shady. I know how GM's ban people. But I don't know how warden does it.

WoW only scans within its own Address space. WoW only cares about what happens inside of wow and that's it. you guys need to stop being paranoid, because you keep spreading it amongst yourselves, like some rabid disease.
