i want to buyout items that have been set in for too cheap and sell them to a higher price via bot.

did somebody receive a ban for doing this?

Someone, somewhen, somewhere probably has been banned for that at some point.

Getting banned doesn't have anything to do with your exact actions. As soon as the activity is inhuman you risk getting banned.
Play the AH for 24 hours per day and you *will* get banned.
