Part I: Knee Deep In Crocodiles http://www.thebuddyforum.com/demonbuddy-forum/56789-activision-blizzard-inc-has-settled-lawsuit.html

Part II: The reply below in Part I ...This is a perfect reply! It address's the heart of the matter.
Nothing spectacular. It's Devil-EA vs Devil-ActiBlizzard. Takes a larger Devil to beatdown a smaller Devil.
Demonbuddy is only a mini-demon.

In the U.S. we do have one who is larger then Buzzard.

It is called the US Government - Dept of Justice - AMERICANS WITH DISABILITIES ACT.

ADA Home Page - ada.gov - Information and Technical Assistance on the Americans with Disabilities Act

For those who experience disabilities as defined in the ACT. They have a right to file a claim to invoke the sweep of congressional authority, including the power to enforce the fourteenth amendment and to regulate commerce, in order to address the major areas of discrimination faced day-to-day by people with disabilities.

One who qualifies, will need to be able to present documented evidence in a statement and example as "DemonBuddy has allowed me to play Diablo III". "Taking DemonBuddy away is a malicious act in violation of the ADA". "I can no longer playing Diablo III without DemonBuddy".

Laws are being passed to support and validate any who may have challenges/disabilities, and qualify by the Act definition. Two minor but very important examples are: Nationwide public pools (including Apartment complex's) now are required by US Federal Law - elevators to accommodate any with physical challenges. In addition too website design for those with visual challenges - Accessible Design, less restrictive, but still monitored with those interacting with the public .

Americans with Disabilities Act of 1990,AS AMENDED with ADA Amendments Act of 2008

(b) Purpose
It is the purpose of this chapter
(1) to provide a clear and comprehensive national mandate for the elimination of discrimination against individuals with disabilities;
(2) to provide clear, strong, consistent, enforceable standards addressing discrimination against individuals with disabilities;
(3) to ensure that the Federal Government plays a central role in enforcing the standards established in this chapter on behalf of individuals with disabilities; and
(4) to invoke the sweep of congressional authority, including the power to enforce the fourteenth amendment and to regulate commerce, in order to address the major areas of discrimination faced day-to-day by people with disabilities.

How to File a Title III Complaint | This publication details the procedure for filing a complaint under title III of the ADA, which prohibits discrimination based on disability by businesses and non-profit agencies. (Spanish edition available from the ADA Information Line.)

Respect to all who may be experiencing challenges/disabilities - Kick some buzzard tail, enlist the US Govt to back you up.

I honestly think that most people wouldn't care if bots were only used by disabled people, and if they saw it they would accept it but this will never happen.

As liberal as the govt has become, i wouldnt be surprised if this worked..

Theories about taking Blizzard to court, one way or another, have been around since the dawn of time. Can't remember any of the ideas actually going through. It just seems you have a lot of time on your hands :)

Are you calling a disability and US law a theory?

Some have the data and facts handed to them on silver platter and they still deny something is real.

Forbes News : Blizzard Faces A Class-Action Lawsuit In Korea Over 'Diablo III' - Forbes

This is a big problem with America. You are a sue happy moron, just about as bad as an ambulance chaser. Unless you are actually a disabled person who really is only about maybe 2% of the D3 community needs this software, You would have a reason to maybe make a claim. I doubt it though. So stop blowing smoke, all it does is work people up for no reason.

its not in america though... go find disability laws in germany or europeon laws, im sure its more liberal than usa anyway

if it fails bossland can claim asylum in ecuador and release demon budy from there

Too funny.

Indeed. Please, people. Take off the legal armchair hat. It's one thing to copy/paste a code section from the ADA. But it's another thing to put a ludicrous spin on how you think the law could be applied in your wildest wet dream and label it all as "facts and data." This is why I love the internet. People make shit up and call it "fact."

OP, let me break it to you. There is nothing in Title I-V that comes anywhere even close to covering providing for bots for disabled people. I don't think we've ever had a single case holding that the videogaming industry has to provide reasonable accommodations...in the form of allowing for bots. And even if some attorney were to bring a civil suit on such grounds, he'd probably be laughed at by the judge and have sanctions smacked on his ass for bringing frivolous litigation.

That's another thing I love about America. We make hundreds of jokes about lawyers, but as soon as we have our panties in a wad, we're all ready to sue anyone and everyone.

Thanks for the free entertainment. If I didn't know any better, I would've thought you were trolling.

$10 says OP is not a law student, lawyer, law professor, or any type of legal expert whatsoever.

It is clear you have never experienced a disability, nor have ever had a friend or family member with a disability. Lets get this right, this post has no value since you have no disability? The only smoke here is what you brought to the table.....nothing.

Left out three other countries now sue happy on Buzzard.... France, Germany and Korea. Do not see US with any active suits...yet. Could it be you are from one of those three countries?

How many threads do you need to spout this shit off in?

There were hundreds, to THOUSANDS of similar style cases for the downtime in WoW over the years, 0% of them went ANYWHERE.

Furthermore, if you bothered to read your article, or the Korea Times source link, you would realize there is no lawsuit yet - just the wish of one.

*As an edit, I will point out that I left the ADA portion untouched - the OP is so absurd in his assessment of what the Act is, and how it can be applied/what it applies to. I would keep going, but I believe Jack will do a much better job.

Try going to law school for at least 2-3 years before thinking about posing as a legal expert. Then we can talk.

You would be surprised what passes for disability in the U.S..

How about obesity? Why it sure does. All you have to do is go to the doctor and ask for help. Once you fail all of your doctors attempts to help you lose weight you are considered disabled and can collect Social Security. While I don't agree with this I know an idiot that has done it. I actually had to research it as I thought he was lying.

Illiteracy? Why not! If you can not read you are considered disabled and qualify for any and all diabled programs/laws.

Just about anything can be considered a disability in the U.S.. Hell in some ways we are all disabled. We probably have the biggest disability of them all. The American government!!! ;)

This is a joke and only a joke. Please don't this is a confession of my retardation or as evidence that democracy has failed. Unless you want to!

:)

I won't question whether any of your claims are true.

But to anyone else wondering. Assuming these are true for moment: How would a lawyer in his right mind go about filing a discrimination lawsuit against Blizzard for banning bots? Which code sections of the ADA do you propose we resort to invoking? Would you like to give us a few case law citations?

Practice Tip: Lawyers don't get paid to make stuff up.

Jack99 that is a great point!

This is one hell of a long path, that probably only could begin with complaints filed to ADA.
At witch point an attorney in time..maybe long long time...would step up on behalf of the individual(s) via ADA.

You are right, until a attorney(s) step up, it is only the complaint stage.

And if you are not from the US, all the statements shared above are true and documented.
If you are from the US, you need to go out and see what is happening, open your eyes!
It is not all for the best.

...

Wat?

I think just about everything I said went over your head. Too bad no one took me up on my bet. I would've been ahead $10.

Congrats on your 2-3 yrs of schooling... Respect!
Know you will be great at your profession when you get your first win under your belt.
Keep in mind once your through with schooling...text book studies and Professors.
The real world will expect....no...it will demand... you to not only observe and comment, but to take action!
Or as some would say Put up or Shut up! Posers verses doers, you got that right. The time is now to do something.

Good luck with your career, wishing you the best!

Ummm...here's the thing. I went to college. Never went to law school--though I do have a couple of friends who're sitting for the bar. It's funny that you're advising me to "take action" when you're the one "observing and commenting" on something so ridiculous as a disability discrimination lawsuit for a bot ban. From a computer. On an internet board. Wouldn't you agree that's a bit hypocritical, Mr. Keyboard Commando?

Here's the funnier part. I didn't have to go to law school to know you were full of crap. Interned one summer during college for an employment discrimination attorney and helped him with his motions and briefs. The one who should "put up or shut up" is you.

Posers vs doers? Again, we'll talk once you've proven to us you're not a wannabe lawyer. Actually, I take that back. The burden's still on you to prove you're not just another snot-nosed keyboard commando.

EDIT: By making the idiotic assumption that I went to law school and choosing to focus on my unknown credentials, you pretty much implicitly conceded that you've been making up stuff along the way and misinterpreting statutes. You haven't come up with anything close to a plausible rebuttal to my earlier points, so you're attacking my credentials because you're without an argument.

Given enough rope, you have just hung yourself! You have just revealed exactly ...what ...you ...have been doing in this thread ^^^ .
Grab a mirror and apply all you just said to yourself, it is a shoe that fits. We are all hypocritical at one point and time. All of us. Some of us are able to admit it and others never will. Put me on the top of that list, yours is also belonging on it at this juncture.

Your posts are inviting this thread to be closed.

Keep it up... and you will win and lose... both at the same time.

I'm just shooting down your posts point for point and you can't come up with a solid rebuttal. Go back and reread your last few posts. I tore apart your weak attempt at constructing a legal argument. Again, I have yet to see you counter any of my points.

Nice try, but that's like saying "We all lie at some point, so the fact that I've admittedly been talking out of my arse all this time is not important as I'm sure you've lied at least once in your life."

I don't know about you, but that sounds like a pretty cruddy excuse of a argument. It has no place or merit. You're trying to turn this around on me with no avail. Thanks for the free entertainment. But you couldn't hold an argument to save your own life. Sorry, but you really should consider keeping your day job. And I really hope for your sake that job doesn't consist solely of being a keyboard commando. Seriously.

I've had my fun here, but I'd rather not take up a space of the front page of DB forums with this thread, so I'll stop here. I must say...I originally clicked the thread topic link hoping to get some lulz and was not disappointed!! You, sir, should be a comedian! :D
