Your BNet account doesn't get banned. The game license attached to that account does. You can still buy/play Wow, SC, or any other game even if your BNet is banned from Diablo 3. So no, you keep your money.

If you buy a new copy of D3, could you still attach it to the banned account?

I'm not sure. You might be able to contact customer support to switch out the keys, but no guarantees. Recreating another battle net account is free though..
