I really want to start again, but I'm apprehensive.

So, a few weeks ago my account got closed. Anyway, I got it reopened and I swore to never bot again. Now the itch is coming back,I used to gather for 12+ hours and the ban was for hacks. If I were to come back it would just be for dailies and leveling toons. No BG's or anything, but again I'm apprehensive. Can Blizzard really see what you're running in the background or is it just "This clown has been on for 16 hours gather herbs, lets ban him"?

Blizzard are allowed to see what you're running in the background but they don't. Just don't do anything stupid and you'll be fine, don't bot too often either.

if anything wouldn't it be Blizzard aren't allowed to see what you're running in the background but they do?

Again it would only be to level toons and do my dailies. I would supervise. I had been botting almost a year but when MoP hit I became greedy and started going crazy. Also, I used Arelog and I hard that may trip some magic blizzard has also alerting them.

blizzard allow themselves to scan your computer... ram and wow folder. several country's do not allow blizzard to do so (law is over ToS).

but the answer to your question is pretty simple. if you don't want to lose your account, don't bot. if you bot, you risk to lose your account. now you have to decide, how valuable your account is

Just do not bot 24/7 ..
And in BG any form of botting - given the "mechanical" behaviour at this moment - is asking for trouble.

On-topic:
Blizzard staff will *not* actively establish a remote-connection to your system to monitor your activities, but the game *itself* is able to take a snapshot of your memory and active tasks. It will be able to send that information out to Blizzard.

The TOS is very clear about this :

"[h=4]Consent to Monitor.[/h]WHEN RUNNING, THE GAME MAY MONITOR YOUR COMPUTER'S RANDOM ACCESS MEMORY (RAM) FOR UNAUTHORIZED THIRD PARTY PROGRAMS RUNNING CONCURRENTLY WITH THE GAME. AN "UNAUTHORIZED THIRD PARTY PROGRAM" AS USED HEREIN SHALL BE DEFINED AS ANY THIRD PARTY SOFTWARE PROHIBITED BY SECTION 2. IN THE EVENT THAT THE GAME DETECTS AN UNAUTHORIZED THIRD PARTY PROGRAM, THE GAME MAY (a) COMMUNICATE INFORMATION BACK TO BLIZZARD, INCLUDING WITHOUT LIMITATION YOUR ACCOUNT NAME, DETAILS ABOUT THE UNAUTHORIZED THIRD PARTY PROGRAM DETECTED, AND THE TIME AND DATE; AND/OR (b) EXERCISE ANY OR ALL OF ITS RIGHTS UNDER THIS AGREEMENT, WITH OR WITHOUT PRIOR NOTICE TO THE USER."

So it's up to Honorbuddy to "hide" itself the best way it can ..
There are certain techniques to do that, but I'm afraid all virus-scanners will go berserk :)

Anyway, knowing all this doesn't prevent me from using the bot for questing.
Let's not be too dramatic about it.

It's a choice, like anything in life.

now one thing you got to keep in mind, botting has never been safe and it will never be... but if you, as you said. only gonna bot leveling / dailies. it's alright. trust me... reports and stuff start coming when doing BG bot, multiple++ hours of farming etc ... but there's always a chance to get banned, always.

buy a full new game under new name new email for 35 euro and go nuts.
wow is on a 65% offer atm

Yes, I agree - they recently had a special of BattleChest for $5. This included up to Wrath of the Lich King, this time. If you value your accounts too much, don't bot them - bot a throwaway $5 account.
