[General] question regarding court facts?

Well my wife and i moved out but had our roomate take care of my cat even know we do not like this roomate he loves cats, and since it has been a year i feel i might have to take him to court, when my wife and i moved out i wrote up a contract and had him and i sign it, with my wife sign it as a whitness, now my question is, a lot of people are saying "You can not bring him to court over a pet, just over the money for the pet" my question is, being i have a contract/agreement for the pet and i know he still has the pet at this time, would i be able to bring him to court over getting the pet back if it came to that?

look all you gotta do is find a shelter, (no-kill shelter) and drop the cats off, if you know where to find the guy tell him he can pickup his cats there. if he doesn't then they at least have a chance of finding a good home.
 
no what i mean is it is my cat that my old roomate is holding onto, i wanted to make sure i could get him back through the courts if the old roomate does not go along and give him back due to the agreement he signed, but it is my cat that is being taken care of by my old roomate.
 
im sure you could, people do that kinda stuff with dogs and what not. however im sure with some sweet talking you can get the cat, not all people are complete jerks.
