Diablo 3 Bot, botting and possible legal issue?

Will there be a Diablo 3 bot available? And if so how or what are the legalities of botting for REAL currency. I mean, getting banend for farming gold is 1 thing, but im assuming that farming for items/mats and being able to make a good profit can possibly get you sued by Activision. Any thoughts?

A Diablo 3 bot is currently being developed.
I haven't read much about it here on buddyforum since I'm not buying D3 when it's released.

But I think that they will watch online-time closely.

Haven't heard much about diablo 3. Is it a multi player game or just a single player game with an auctionhouse?

Blizzard takes a fair cut of every RMAH transaction, so I actually expect them to ignore all but most outrageous cheating in D3.
