Constantly trying to upgrade maxed gems

I have noticed that my bot will run grift and then try to upgrade a maxed gem over and over and over. The logs say it has 100% upgrade chance but I watched with my eyes: it's chosen a 50 maxed gem. I've noticed this before as well.
I tried putting low level gems on my guy, I tried running gem upgrade mode and non gem upgrade mode.
