Probably release.
The only anti-ban protection is to not bot/RMT in the first place, and not have any associations with accounts that do. 
GGG uses server-sided detection to catch botters. Some people get lucky with their botting habits, while others do not. You can assume GGG checks IPs, hashed MAC addrs of the PC being used, and any associations of the account in question (e.g., if you send bot items to a legit account, they will ban the legit account.)
The new Beta has large structural changes made, but not related to any bans/flags. GGG will not ban you less for using Beta or Release, as you're still botting.
Path of Exile is not a bot friendly game, and will never be. GGG is active in identifying and banning people, and have been that way since they started Open Beta. You can assume they will only get more aggressive as time goes on, especially with the new expansion coming out and a new flood of people coming in.
