A little confused..... What do you mean by "swimming up"? For farming it should use aquatic form, then when it encounters a threat it should switch to the form you are specced in to. Or maybe I am just reading your question wrong. Vodka has its strange ways of distorting words ;)

This has been covered / discussed dozens of times as I, like many, have witnessed the "conga line" when farming nodes. As was pointed out to me, you can not tell others how to play or use the bot. All we could hope for is that people would be smart enough to use it properly.

Like the above stated, there is always a risk. No one here can tell you for sure what they will do to any of your accounts, especially not knowing exactly what your intentions will be. If you are going to bot extensively on an account and farm 16-18 or more hours, sure your risk is pretty...

Yes you can recruit yourself and yes you can send heirlooms *IF* the other account is under the same battle.net account / email ( same server )

I don't see how they could hold you criminaly liable, however, the owner of the card or the issuer would certainly have every right to try to recover the funds. It's certainly fraud so I hope you are no longer doing business with this person.

Blizzard can choose to do whatever they feel like. What may be policy now, can change tomorrow. "Safe" is a huge grey area. Botting has its risks period.

Did you try disabling x-fire? or just using 1 card?
