Banned for botting... Pre-buy of WoD should be refound or ?

Wrong, wrong wrong. If you get banned for botting, they provided you service. At that point, they have no reason to refund you anything.

And guess what else Blizzard can do? They can have a collections company come after you and destroy your credit.

Which is more worth it to you? Losing a $30 wow license or having your credit destroyed because you think you're in the right?

Jesus. How hard it is to comprehend what a Preorder is? You really seem to have an issue there.

Anyhow, would love to have you as a customer. You despise your rights and take whatever you are spoonfed on the ToS as the one and only truth(that aren't legally binding as a full contract. They are and act as an AGREEMENT, and therefore, are extremely easier to confront on a court.)

Of course 99% of us wouldn't care enough to actually sue them. Too much hassle for too few to win. But , when they actually find someone who does give a fuck, the consequences could be pretty harsh if it sets a precedent.

I was banned and got a refund on my collectors edition couple of weeks ago!

You are wrong, and you should stop saying things like this. It clearly says on the Blizz store that there is absolutely no refunds. Guess what that means? They don't have to give you shit back. Once you paid, that money is theres and they are free to do whatever they want with it.
ryft, normally i agree with you on the forums. but you are 100% wrong on this. i experienced this exact thing before WOTLK. i was banned just before the xpac went live and demanded a refund. they unbanned me at first but i demanded a full refund and received it. I also could have got any attorneys fees covered too when i had him write a letter. The attorney is my best friend so there were no fees.

So, stop for a second and realize that you might not be always right. i will give you most of the time, but this is not one of them.

and the moral is??? kick scream and complain and go back to those years when you couldnt get the toy you wanted because of your parents. It works with big business. Seriously. Worked customer service long enough to know you keep calling in about the same thing over and over, you will get what you want. up to and including phone sex with a manager. Don't quote me on that!

Why do you preorder on a bot account in the first place?
WoD is getting cheaper and cheaper compared to the preorder and as you noticed there is always a risk of getting banned and losing more money than necessary.

I will buy WoD on the 12.11. for way less than the preorder price

Really? Prices on the regular and special editions are both the same as when they first started selling and I highly doubt their prices will go down the weeks, maybe months, following the release of WoD. I gotta go with your question though - do not spend money on accounts you use to farm with.

Now, OP, you can try to get a refund through customer service, but I doubt they will do it. Technically, you already "received the service" of WoD, since it is attached to your account and you will have access to it as soon as November 12 hits, but don't quote me on that.

EDIT: Well, had access to it once it comes out.

6. Account Suspension/Deletion.

BLIZZARD MAY SUSPEND, TERMINATE, MODIFY, OR DELETE ANY BNET ACCOUNT OR WORLD OF WARCRAFT ACCOUNT AT ANY TIME FOR ANY REASON OR FOR NO REASON, WITH OR WITHOUT NOTICE TO YOU.

So, in the way that i see things. Blizzard could ban everyone in the world, and it would be "legit". Lose a lot of customers, probably 99% of them, but still, i dont think we could do anything about it.

Thats a big mistake ... first we got in germany very hard laws about selling and waranty.... this is special for germany... the customer rights are very high here and we got a big non-gov-organisation who keeps that rights it calls "verbraucherschutz" .... their decissions about something are nearly like a court decission.... blizzard know about that i think

Now to me

I habe created a Support Ticket with a 10 days to response notice.... if blizzard dont pay back so i get my money through my bank.

In germany is everybody able to cancel a pre oder without reasons and you have 2 weeks when u recieved the Product the chance to give it back without typing of any reasons.

No there are no refunds. The pages and pages of people saying they have been banned and received the refunds are all liars.

This is what I love about online gaming! Everyone is a know-it-all! People will tell you crap with confidence when they have absolutely no idea what they are talking about. They also seem to think it adds credibility to their argument when they use foul language. I run into this all the time ingame. People tell other players how to do things when it is obvious that the one giving advice does not have a clue. A few people in this thread have had experience with this issue. The problem with their "voice of experience" is if you get a different GM you may get a different response. :-)

It's a "PRE-ORDER" you never received the item. You have a legal right to a refund.

If someone purchased any type of PRE-ORDER, for any type of merchandise, and lost interest in it, then they are entitled to a full refund for that item. It doesn't matter what happened, because you never received the item, so you are legally entitled to the monies back.

There should also be an option within the Blizzard store to cancel your order. If the option is not in the store, then contact Blizzard billing and request a refund for the PRE-ORDER. If the Blizzard billing department gives you a fuss, then call your bank and file a charge-back for items not received and an unauthorized charge. Technically, you hadn't authorized Blizzard to charge and pull monies from your account until the day the expansions release date, legally, Blizzard can't pull money from your account until after they provide you the content, most businesses place a HOLD on monies, then charge you the day the product is available.

This has nothing to do with PRE-ORDERS, billing, non-received merchandise, nor the law. Any Company can put anything within their ToS, but that doesn't make it law, nor does it make a Company immune to law. There are specific Federal regulations of how, and when, a company can remove monies from an individuals account.

See now the issue with that is. everyone has received SOME of the order they paid for. we all have received the digital items across all 3 games. the only thing we have not received is the Expansion. however when you buy the expansion there is a ToS that you agree to allowing blizzard to withdraw the money from your account and also allowing them to not refund you if they don't want to. in the instance you have been banned for breaking their ToS you are now exempt of the rights you had towards their policy. you broke their rules you don't get money back when you break the rules.

The fact that you want your money back because you got caught cheating is comical IMO.
